Is it just me, or does Karmazin's interview tour this week seem like a half-hearted beginning of a "lotto ticket" end? As a long, I'm discouraged. Any light out there?

More snake oil. He said all of these things about growth, CFBE, profitability years ago when Howard came on. Now the stock is half the price it was on the day he started as CEO.

My guess is that SIRI XM will file BK and finally kill off the shareholders who have supoprted them for so long.

4 Years and absolutely nothing to show for my investment. I'm sick and tired of hearing Mel's bullcrap already. Mel has everything he wanted in order to increase shareholder value. They got Stern, They got NFL, They got the automakers, They got XM Radio. Yet, the stock price hit an all time low. I don't want to hear anything from Mel and crew anymore. I want results. Else, the whole bunch needs to go. Enough is enough and Mel does nothing.

Thanks for your perspective, Jopo. After required hoop-jumping and resultant excessive delays to merger, I would think MK would feel compelled now after this week's "win" to show respect for long patience and support by addressing the plunging share price concerns of shareholders. Maybe that'll happen soon.

Mel had no choice but to buy XM or he was dead. He knew this. Stern, the NFL, etc, etc, weren't bringing the bucks in like he hoped. He had the content, but not the substance, the distribution, or the OEM deals that mattered. XM had all those, so he had to buy them to ensure his survival.

Now that the merger is over, you can't expect the stock to skyrocket overnight. You have a company with over a billion in debt merging with another company with over a billion in debt. They have to take care of this first.

This is a stock for longs, meaning very longs. We're talking about 7-10 years away long.

You Fools, When the company merged, you wanted the stocks to rise. Now that you have wait to see , now you all complain. It sounds like you all want it all , and want it now! The only movements that some of you know is from the bowels.
With the economy today, things will be hard for a while. But I will be sticking in there with all my investments, knowing the market will move again.

You have to realzie a couple of things. 1. Mel would have never poaid Stern that contract. Stern is the best thing to happen to Sirius but he would have gotten him cheaper. 2. He knows how to control costs and the fact that he is not going to be competing with XM's dumb spending (Oprah) the costs wil lgo down more. He didn't have to come to satellite, he went there after they signed Stern because he seen the opportunity. I see nothing but light at the end of this tunnel. The FCC/DOJ bullshit wasn't his fault.

Firefox249, No need to be derogatory and demeaning. Of course, there was the hope of a share price spike (or some positive movement) at merger, followed by disappointment. Was that not your hope too? I'm not complaining about the status quo as I believe in the product and in the value of investing. I have much patience, contrary to your assumption--have been a Sirius investor for 4 years. While grasping the concept of our down economy, I'm simply wondering at this point about the possibility of my investor patience ending at $0 through a bankruptcy filing. It's an odds game. Slim and none? Unlikely? Quite possible? - my questions as I look to the future. The gaining of a little guidance from those more knowledgeable than I was my intent in writing.

With 19 million and growing subs Sirius XM is not going BK. I guess that there will be pain before gain. I was hoping for a better route, but this is investing with a hint of gambling. I just want them (SIrius) to get a new mindset about their spending habits. They're the only game in satrad town now and there's no need to compete with a nonexistent satrad company. Make a content providers a fair offer. If they don't want it, WALK. Same goes with executive compensation. Let them demonstrate their worth and then compensate them based on results that can be directly attributed to them. It's a new company and hopefully a new mindset. Focus on profits as without profits we are simply spinning our wheels. Think out of the box!

ICE vendor relations director David Schwartz said the group’s goal is to increase HD Radio product sales from Kenwood, Pioneer and Peripheral, and other ICE partners, by educating sales people about the feature.
“ICE has found that independent retailers are not including the HD Radio feature on the sales floor when offering products which have HD Radio capability. The issue is that salespeople do not have experience with or knowledge of HD Radio … Working together, iBiquity and ICE will increase the knowledge and awareness of HD Radio on the sales floor, ultimately translating to increased HD Radio hardware sales.”

So How Are We Doing: A Conversion Reality Check

Welcome and thanks for finding your way to my initial online column, "Thoughts on Radio’s Digital Future". My intent is to fairly regularly put fingers to keyboard and give you all a candid inside view of what we at iBiquity are thinking and doing to speed AM/FM’s conversion to digital.

Importantly, I’d love your feedback. It’s thoughts@ibiquity.com. I read them all and try to respond to everyone but the truly loony and those peddling commercial real estate. I commit to consider all the feedback I get, and to bring interesting viewpoints into future columns.

I’ve been inspired in this effort by many in radio who write regular opinion pieces, so let me give them their propers. Peter Smyth, Paul McLane, Fred Jacobs, Dave Martin and the Edison guys have great thoughts with which I generally agree. I regularly read Mark Ramsey and Jerry Del Colliano too, usually fundamentally disagreeing but always being entertained. There are many others adding to this healthy debate. The passion of radio people never ceases to amaze: it is a great strength and may be our saving grace.

So with that intro behind, as a first topic, let me try to answer the simple question I get asked the most: ‘how’s it going?’ In a word, fantastic.

That answer may surprise some, given a lot of the contrasting opinions out there. No one is better at beating up radio than radio people. I will qualify my assessment by highlighting the reality that there is a long way to go. More on that later.

First, the fantastic part.

Broadcasters have built a comprehensive HD RadioTM broadcasting infrastructure, with almost 1800 stations on the air covering more than 80% of the population. Almost 50% of radio listening takes place on stations which have converted to digital. Big markets like NY, Chicago, LA, Detroit and Washington are saturated with 20 to 30 HD Radio stations. On average, one station every day converts. More than 800 stations have new HD2s and HD3s pumping out diverse content. Two years ago, when I pushed a receiver manufacturer or retailer or automaker to include HD Radio technology in their mix, the overwhelming response was "why would I do that when there are no stations on air?" I rarely get that pushback now.

We have more, better, cheaper HD Radio receivers being widely distributed. More than 60 different types of HD Radio receivers are available in all segments – OEM and aftermarket car, high end stereo, home and table top. Recognized brands like Sony, JVC, Yamaha, Jensen, Panasonic, JBL and Polk are selling product. Prices have come down to the $79 level (we were at $199 two short years ago). And those products are available at more than 12,000 storefronts across the country. Go into a Best Buy, Circuit City, Wal-Mart, Target or Radio Shack, as well as many regional retailers, and you will find HD Radio receivers (granted, you may have to ask a few times).

The car momentum is accelerating. BMW and Mini offer the technology across their full lines. In the past twelve months we’ve had announcements from Ford, Volvo, Hyundai, Mercedes, Toyota’s Scion, Jaguar and Land Rover about their HD Radio launch plans. Most of these automakers will be rolling out HD Radio equipped vehicles this year, so stay tuned for that, as well as more auto announcements.

I could go on about new applications and money making opportunities for broadcasters like multicasting, iTunes Tagging or instant traffic distribution, or the progress on getting into portable devices, or the exciting international scene, but let me save some of that for future columns.

I look at all that progress in a fairly short time and get tremendously excited. When I read some of the strident HD Radio critics, I am reminded of the Seinfeld Superman Bizarro world episode. Things will never be perfect and legitimate criticism is helpful, but doing so by ignoring the tremendous momentum described above is delusional or dishonest.

But there is still a lot to do and we are a long way from clinking champagne glasses. Our industry must keep converting stations, putting quality HD2 and HD3 programming on, and promoting the digital upgrade to our listeners. We can’t stop with dozens of radio SKUs, we need hundreds. The retail scene has gotten better, but we have a long way to go on sales floor knowledge, merchandising and product demonstration. And we need to be in all cars, every last one. These are our challenges and objectives, and we won’t quit until we have attained them.

But we all have to recognize that for an industry that has been around almost 100 years, a total upgrade will be a long term proposition. Think of how long every other mass media upgrade has taken – black and white to color TVs, AM to FM, and most recently, digital TV, even with a conversion mandate. Comparatively, the HD Radio transition stacks up quite well.

A little history lesson, which was given to me by one radio’s legends, Jerry Lee, may be helpful. FM broadcasting was approved by the FCC in 1940 and was given its current frequencies in 1945. Jerry put WBEB on the air in 1963 (I remember that because it is the year I was born). There were no FM receivers available, so Jerry had some manufactured and gave them to his listeners. Oh, they only tuned to ‘BEB.

You know how the story ends. After years of broadcasters giving away their FM licenses and consumers enduring AM simulcasts, some smart programmers got busy. By the late ‘70s, FM had taken over as the dominant listening medium.

So when I hear a naysayer urge me to throw in the towel, I chuckle and think that’s like pushing to shut down FMs in 1967. We now know that would have been ludicrous back then, and it’s just as silly now.

Every other consumer medium is digital already or on a strong path to get there, and radio cannot be stuck in the analog world of the last century. Our future is digital – online and over the air. I’m encouraged by our progress and hope you are too. We will get there together.

What the NAB fails to understand is the difference between the quality and public acceptance of satellite commercials vs. the quality and acceptance of commercials on their terrestrial stations.


Your broker is right as a rainbow about satellite commercials. Satellite attracts advertisers that pay very low rates and broadcast 52 percent of airtime vs. an average of 42 percent of airtime and higher rates on conventional stations.

Most satellite advertisers peddle products and services with claims that are so bodacious, so stuffed with misleading and corny exaggerations and so baroque that the commercials are often more entertaining than the programming. Many satellite listeners have shared their complaints with me and some are really sad stories.

In six years, neither XMSR nor SIRI has been able to earn a pfennig. A merger between the two would have the same effect as putting two viruses on a Petri dish, each continuing to reinfect the other. I don't see a clear growth to profitability. I suspect that the terrestrial competition, the success of iPod and iPhone, other wireless devices, the collapse of auto sales and a recession that will become much worse might smother the growth of satellite."

Not one comment about the Severance package being reported today in the Washington Business Journal. $10 million, that is $10,000.000.00 dollars. There are many people in management, like Gary Parsons, that beleive in the company and buys stock. They should forgo the pay and the incentives until a profit is made.

There is a big difference between being paid at a decent level and looting the company. This is one person, can you imagine the sum total of the packages. This coupled with the $100 million spent to get the merger done it too much.

Lets take a look at a key OEM channel for Sirius. Ford. Ever hear of Sync? Voice activated music device. Sounds pretty cool. Much cooler than a shitty sounding satellite radio service.

Im a fan of the "technology". But i wont be shocked when Mel and Co make their money and it all goes to shit (like it hasnt already).

The fact is that one year from now revenue will grow only 250 million and savings will be 400 million yet the company is losing 1.1 Billion plus new satellite build costs.

2009 SIXM will lose 500-700 million dollars and be within 500 - 600 million of being chapter 11.

In 2010 revenue will jump to possibly 450 million but 350 million will be lost when Stern retires on 1/1/11. In 2010 Sixm will be out of cash and still losing 300 million a year.

Technology advances exponentially. No one knows exactly what the advances in Satellite Radio are going to be. This is essentially a new and improved medium of communication (improved radio)
FM/AM Radio sucks right now, and maybe it will turn out that Satellite radio will one day allow commercials and sell airtime to companies specific to specialized channels, connect to IPods, connect to mobile phones, connect to cable TV, have a sort of Satallite radio walkman, worldwide distribution, channels catering to Europe, Asia, Africa, the Americas (south, central) It could become a global communication device advertising products, like the internet but cheaper and without pictures or spam e-mail.

Again, technology advances exponentially, meaning that this Satellite Radio thing may totally reinvent itself in a year or innovate more in the next year than it has in the past 5 years. The infrastructure is there, the company can break up into dozens of smaller companies catering to specific markets, regions, countries and so on. Maybe it replaces AM/FM radio in the future? nobody really knows.
Porn channels would definentily raise revenue and pretty much knock out telephone porn lines. And no, I don't own any stock yet, this is a new technology it will take a while for it to be fruitful, Remember when the internet was made available to the public, it was availabie in my college before, but we just used it to chat or email, look at what happened to that medium.

llegal Short Sellers May Face RICO Indictments

The SEC's crackdown against illegal naked short selling and rumor-mongering resulted in more than 50 hedge funds being slapped with subpoenas last week, according to the Wall Street Journal. Conspiracy theorist and CEO of Overstock.com (OSTK), Patrick Byrne, has embarked on a crusade to expose the nefarious hedge funds that practice illegal short selling. Byrne's web site, Deep Capture.com, has compiled a plethora of facts documenting, names, dates, times and videos of the players and their schemes.

Mark Mitchell, of DeepCapture.com, believes there exist a "hedge fund-orchestrated campaign to cover-up the crime of naked short selling." Depending on how deep the SEC probes, and what insidious facts they discover, we could see hedge fund managers, traders, and other employees facing scandalous, unprecedented charges under the infamous racketeering law, RICO. There is growing pressure for whistle-blowers to sound off or risk becoming the next scapegoat.

Clusterstock.com, reported, "the SEC is demanding both trading records and email correspondences" from subpoenaed firms. The inclusion of cell phone and text messaging records will undoubtedly be scrutinized. Concurrently, the NYSE Regulation Inc. is also investigating how some of its largest firms comply with false and misleading rumors that could undermine a stock's price. This is going to intensify.

Motley Fool, published an article on March 24, 2008, titled "The Naked Truth on Illegal Shorting," in which 100% of a company's shares were purchased by one individual, and were not available for shorting. Nevertheless, 60 million phantom shares were traded, according to owner. Subsequently, he filed a SEC 13-D compliant form.

Dick Fuld, CEO of Lehman Brothers (LEH), told market regulators that he has information that short-selling hedge funds colluded to bring down Bear Sterns (BSC). If Fulds's "information" is of evidentiary value, these hedge fund managers, and their cast of cohorts, could find themselves behind bars.

If the SEC diligently investigates the facts, we could see RICO indictments against illegal short sellers as early as Labor Day. Anyone charged under the RICO statue, even if they are found "not guilty," will become permanently damaged.

After observing the demise of Fannie Mae (FNM), and Freddie Mac (FRE) last week, it is expedient that the SEC move quickly to abolish the practice of naked short selling for all stocks. Short selling should only be allowed after the short seller has successfully borrowed the shares. The practice of selling shares that cannot be borrowed is a crime!

If you are investing in SIRI-XM and are not a subscriber, then you need to re-evaluate your belief in your investment. So many folks will put thousands of dollars into the investment, but not spend $12.95 on the very thing that will allow stock owners to make money. Think about it.

Also, if you have to yell and cuss about SIRI-XM or Mel, try a different approach. Supporting the company and its leadership might go a long way towards where we all want to be . . . in the green. Something else to think about, because I tend to tune people out with the loudest, foulest mouths. It does not make a good argument or point. A mature approach might be appropriate at this point. With that said, a year from now, I will back away from this line of thinking. :-)

I applaud Mel and the others for working to get the merger approved, and still thank the 3 FCC commissioners for voting for the merger. I do not however, forgive them for taking over a year to DO SO!

I am disgusted with the FCC for allowing special interest groups, lobbyist, and politicians to take up their time after the comment period HAD ENDED.

By allowing these non-consumer groups to do this, they gave them PREFERENTIAL TREATMENT AND an UNFAIR advantage. Also, by allowing this they were telling consumers that "WHAT they SAI D and WHEN THEY SAID IT" didn't matter ONE BIT!

The FCC operated under the THUMB of the NAB, self-serving politicians, and special interest groups like the George Town Partners and HD RADIO.
For over a year these special interest groups, brow beat the FCC into submission, and took up time that should have been used working on the merger.

Anything the FCC officials say now-- is just window dressing to justify the ridiculous delay in working out the details of the merger.
Thanks to the intentional, irresponsible delays authorized by the FCC, the merged companies are riddled with excess debt. Special interest groups and politicians GOT THEIR WISH! SiriusXM is riddled with DEBT. The shareholders (consumers) got the bill for their ANALYSIS PARALYSIS!

Despite Mel's best efforts, I am concerned about the common shareholder of record today.

As for Mel's promise to have positive cash flow... I trust him, but I am concerned that the merged company has been drained of its resources by the FCC, NAB, politicians and other selfish business people.

I'm hearing rumors that V. Irvin, S. Cook, D. Murphy, M. Nguyen, have been told to start packing. I understand tha the SVPs are next and that the non-Board Directors like those that run CC, BB, WM accounts are nervous because they wont be kept on.

And also, how will this crap work. Will I be able to get Howard, Nascar, the NFL, perhaps playboy, there music channels, all on one plan? Also, when will we see the merge content? Doesn't look like it anytime soon. Anyway, HD sucks because on songs that are NSFW are of course edited, OA/Howard would be cencered, etc.

Plus you've got stattic and things to deal with. With HD I can't get replays either.
