Commissioner Tate comments on Sirius-XM merger

fcc-deborah-tate.jpgFCC Commissioner Deborah Taylor Tate has finally issued a statement (technically, two statements) on the now-approved merger between Sirius Satellite Radio Inc. and XM Satellite Radio Holdings Inc.

Tate doesn't wax poetically about the merger like Commissioner Copps, her Democratic counterpart. Instead, she focuses purely on the Consent Decree and Sirius-XM's adherence to FCC regulations.

On a related note: there is a nasty rumor going around that the FCC is requiring XM to remotely shut down all SkyFi2 receivers, because of the wickedly powerful FM transmitters. That's completely false.

As part of the FCC's Compliance Plan (which will last for 5 years, and require reporting every 3 months), Sirius XM Radio Inc. is required to broadcast on-air notices about non-compliant radios, and will replace radios returned by customers with compliant devices.

Which radio's are "non-compliant radios"?

The FCC can get my Roady2, Inno 1, Roady XT A, when it ceases to work. B, From my cold dead hands! I'll NEVER give my FULL FM MOD XM RADIOS!!!

I'll give up my Skyfi2 if Sirius XM Inc will offer me a equivalent pnp radio with dual-service capability. I don't even use the FM mod anymore (direct connect trumps where available). Otherwise forgetaboutit .....

There is no way that I am goign to send my SF in for replacement, its perfect for my truck. When I get a new pickup it will have sat rad so that issue will go away, but thats not for another 8-10 years.

It seems Tate stayed clear of issuing an opinion on why she approved merger.

She played both sides by voting with Martin and her political party, but also coming down on Sirius/XM with penalties and enforcement to satisfy the NAB and democrats to a degree.

I guess the must do alot of cleanup in the next 6 months.

Directed Electronics has said that there were at least two Sirius radios(the S50 and Starmate Replay) that were not in compliance.

XM's Delphi XM SKYFi2 and the Audiovox Xpress are not in compliance.

Any more? Whats the swapping process?

How about the MyFi? I know it has an FM transmitter in it, but after using it twice, I prefer going through the RCA jacks in my home and/or car stereo, thanks...Sound wasn't nearly as good through the FM transmitter.

I have tested my Delphi MyFi and my unit has a usable tranmission range in excess of 100 feet. This was tested on level ground with a 1996 Ford Windstar as the receiving unit. I unintentionaly tested this at 70mph on I-95 with the Windstar as the receiving unit leading the car with the MyFi many car lengths back... no actual length measured. On a trip over 30 miles, I did NOT lose the signal at any time.

I meant to add this. I will turn my MyFi in for exchange with a dual (XM-Siruis) unit which is portable like the MyFi and contains all the cradles and accessories for both home and car like the MyFi.

Otherwise, I will keep it until it no longer works. I think this will be a long time as this unit goes everywhere with me and has proven durability. During the week it is on 8-12 hours a day in the office. It is also used in rental cars, hotel rooms, Amtrack, airplanes, bicycle, home, etc.

I totally agree. i would be happy to turn in any or all of my radios that may be noncompliant, if and only if Sirius XM will replace them with feature equivalent (or better) radios that receive both services and (ideally) support a la carte packages.
I would not be wiling to turn in my radios if they will only offer very basic replacement units. I want a radio at least as good as the one I'm turning in (in terms of recording capability, etc.).
