
Will Sirius and XM gain the FCC's approval? Blair Levin, analyst at Stifel Nicolaus believes so.
"We believe the companies will likely be able to [win FCC clearance]," writes Levin in a recent note reflecting on the DOJ's announcement. "While there is always a risk that three commissioners could decide the merger is not in the public interest -- and in this case we suspect at least one and maybe two commissioners will vote that way -- we note the FCC has never, to our knowledge, rejected a merger approved by the DOJ. We don't believe this one is likely to be the first."Those "one or two" commissioners are likely the Democratic commissioners Adelstein and Copps (pictured above, in order from the left, followed by Martin, Tate and McDowell), who have historically been opposed to media consolidation.
And what of timing?
The last we heard, the FCC might not reach an agreement by the end of this month (one can always hope though). Stifel Nicolaus thinks that the timing will depend on how the two Democratic commissioners will choose to rule: do they impose further conditions? or do they simply oppose the deal?
If it's the latter, the decision will likely be done in a matter of weeks.

I have a bad feeling both XM and SIRI subscribers are going to be very, very dissapointed with this merger once all is said and done. I guarantee that something everyone likes won't make the cut when things are combined.

I hope the FCC makes the right decision here and lets the merger thru. This has been a long time coming. As far as I can tell there will always be the naysayers or folks who don't like things because they don't have this or they don't have that. My only purpose for listening to sat radio isn't because of the talk. Its about the choice to listen to what I enjoy and whether somedays its sirius or XM its still a better alternative then what you get on FM Channels.
Just my Point Of View from someone who has been reading comments and watching this from a distance who has both Sirius and XM.
They will approve with minimal concessions. It is the only way this deal can go through. If they try to ask more than what the companies have agreed to, Sirius will walk!
However, the FCC will want something a little more generous than a la carte and that will be a few chanels for lease or so. But 20% of spectrum is not on the table!
It is sad that the DOJ did not provide a good reason to justify the time they have spent on their review.
As for the stock, it seems that investors are so scared and cold about this merger that they can still not believe it. They have been traumatized for so long that they refuse to buy until everything clears up. However, when this clears the FCC the stock will fly! I see it $9 in a few weeks!!

What a crew
I think it should be obvious by this point that Sirius/XM needs subcribers a lot more than subscribers need Sirius/XM. If they cut channels and piss off subscribers, then they're digging their own grave.
As "fans" of sat radio at least get the facts right.

I think the FCC will approve sight unseen, just like the DOJ. I have both XM (for baseball, FOX Sports Radio and, of course, Opie and Anthony)and Sirius (for football and music, definitely NOT for Hoo Hoo Hackboy Stern). I am sure the music channels will be merged as there are LOTS of overlap. I just hope they use the Sirius bandwidth, instead of XM's. One turnoff to XM's music streams is the God-awful sound quality.
You people need to relax. Once they join forces, if you don't like what's being offered, then cancel!! You people cry like you're bound to something permanant. Satellite radio is not a necessity. Why not put this kind of energy toward complaining about rising gas prices, spending trillion for this BS war, or several other issues that matter!
