FCC Chairman says Sirius-XM ruling possible by June 30th

FCC Chairman Kevin MartinChairman Kevin Martin said today that the Federal Communications Commission could rule on the proposed merger between XM Satellite Radio Holdings Inc. and Sirius Satellite Radio Inc. before June 30th.

"I still think the commission could act by the end of the second quarter," Martin said at a press conference.

Earlier this year, Martin had asked his staff to compile a report on the various conditions the FCC could impose on the proposed merger. Today, Martin said the staff has done what he asked, but he declined to comment on their recommendations.

Martin added that the proposal hasn't been circulated to the four other commissioners.

As suspected, Martin said that the FCC won't consider the merger proposal at its June 12th meeting. This could mean that the ruling might be delayed until July unless the commissioners agree to vote on the merger proposal without a public meeting.

The period to sumbit any concerns has been over for some time. By the FCC continuing to entertain a new person's or group's concerns the decision date gets pushed back more and more. This is not mere coincidence. The NAB et al is causing the delay by simply scheduling their cronies to keep this issue open forever while hoping for a Democratic Whitehouse and then it would be game over for the merger. At the very least the President should pull the FCC on the carpet and grill him for his excessive delay in this matter. Maybe writing to the President would have a better effect than writing to the FCC.

I'm becoming convinced more and more the NAB & FCC doesn't want a decision. Both companies could survive with or without a merger. What's hurting these 2 companies is the in-decision in regards to this merger. Martin seems to tease these 2 companies into thinking he's going to make a decision soon, so that XM-Sirius don't back away from the merger deal, but then continually delay the decision....knowing it's doing nothing more than bleeding Sirius & XM.

The NAB wants Sirius & XM to continue pursuing this merger, but they don't want a decision made. They just want to stall this thing so that neither company (merged or not) can go on about their business. The longer this gets dragged out, the more detrimental it is to both sat rad companies.

What is the point of this process anyways? The FCC will approve it and then Congress will rollback the FCC's decision. Then the President (if it is still Bush) will veto the rollback and Congress will negate his veto with a two-thirds majority vote. No wonder nothing ever gets done in this country!

Is there anybody in government, whether it be at the county, state or federal level, that tells the truth any more? I can't speak for everyone, but personally I have lost all sense of pride and respect for the political system in this country. It really disgusts me how the comments on Orbitcast fall into what appear to be a few categories of people.

1) Stockholders looking for a quick buck. I don't think the fans of the services are screaming for a merge, rather it is stockholders looking for a quick buck who want a big ROI. While investing is a part of life, one of the problems with companies lately are stockholders who have more power than the mission statement or the corporate culture. Do these stockholder's care about the quality of the service? Do they listen to the service? Do they think of the long term? My gut statement is no.

2) Fans of Howard Stern or Opie and Anthony. This seems to result in a lot of namecalling back and forth, and it leads to the dreadful comments thinking one of the other stations will "die". It seems people want either XM or Sirius to die, in their comments. Why? Are things so bad that you want your competitor to die off? For instance, XM has more subscribers, so why would people want the more popular service to die. Is it so threatening that there's another Sat company that people want it to die? Are Howard Stern fans that threatened by any competition or filled with ego that "how dare a satrad provider exist that doesn't carry Howard" that it shouldn't exist? The O&A fans also need to accept that Howard is more popular regardless and just live with it.

3) Fans of "Mel". Really, why? This gets back to the Stockholder people. Mel is not primarily a creative force, he was in charge of CBS radio, which has all the problems people went to Satrad for. While he says they won't have commercials, I do think he might eventually push for commercial content--once a merge is done there won't be that much reason to not have commericals. Analysts have suspected this will be the case, it's happened before. Remember when basic cable channels were commercial free? Remember when Movie theaters didn't have product commericals before the show? A merge would enhance pressure to do this. Let's not care about the consumer as long as our stock goes up a few bucks.

4) The "SatRad haters". While there aren't many of them, that NO to "merge" MONOPOLY doesn't seem to be arguing for anything except to troll what he calls "fanboys". I understand wanting to criticize the merger, but he seems bitter against SatRad fans. Without fans, who'd buy the product?!

5) People who hate the FCC. Really, the FCC's primary goal is spectrum handling, and this DOES affect things. XM and Sirius both licensed spectrum from the government, they have to follow the rules, and if there's only going to be one provider of the allocated spectrum it really makes sense for them to have to give up some of it. This is basic anti-trust 101, and it doesn't matter that other markets compete with their content, the spectrum question is key.

I wish we could have more intelligent criticism. I hope to see it soon. This merger not only has hurt XM and Sirius it's hurt Orbitcast. Where are the new radios? The new shows? At this point I wish they'd cancel this than stagnate. Granted, the FCC is to blame but both companies should not be dependent on the merger for success.

No need for new radio's when it's more than obvious satrad is more interested in nailing the final nail into it's coffin with this "merge" MONOPOLY.

Hey anonymous coward. Unwise investment?? I purchased 50K of Sirius stock in 2003 at about where it is now, and it went to $9. Made me $325K. That was before Mel arrived on the scene, and pre-merger. I'm now in again with over 100K shares and will hold for the long term. Expect to do even better.
