Well, well, well. We don't have to worry anymore about reports of the merger between Sirius Satellite Radio Inc. and XM Satellite Radio Holdings Inc. being a part of today's Open Meeting.Because the Federal Communications Commission has just canceled it.
Instead, the Public Hearing on Early Termination Fees will (conveniently) serve as the FCC's June Open Meeting.
And so, the waiting continues.

The fact is that there was NEVER a open meeting to discuss the merger. This was to discuss the ETF fee's. Martins comments to the WSJ on Tuesday that a draft was not yet circulated should have put this rumor to bed. As much as people want to believe that a vote can be taken without a circulated draft it will never happen. The draft sets the conditions that will be what is voted on and approved. It is not a nice to have document they need to know what they are voting on.
I am amazed everyday with the foul language and misdirected anger. A little fact checking would go a long way with the investors and quite frankly the managers of this board.

The blame for this whole mess and the current sad state of satradio in NA is Mel's fault PERIOD. Fanboy's are desperate to place blame on everyone with a negative opinion about the "merge", but Mel knew exactly the problems he was starting by mentioning it, and worse drving the industry into a tailspin by making the stupid move of trying to get away with it, when the FCC rule clearly states it can't happen. In a nutshell BLAME MEL KARMAZIN.

NEW YORK (Reuters) -- Sirius Satellite Radio Inc. Chief Executive Mel Karmazin said Monday he would like to buy archrival XM Satellite Radio Holdings Inc., but price and regulatory hurdles would be issues.
Karmazin, speaking at a conference in New York, stressed, however, that Sirius's business plan "doesn't really involve our doing a deal" and also indicated he wasn't interested in Sirius being bought.
"Regarding XM - would we like to buy them? Sure. We'd love to buy them. Price would matter, so that would be an issue... (and) there would definitely be the regulatory issue," he said.
"From our point of view, we don't see - other than if it was in the best interests of our shareholders - that we would be interested ever in being acquired," Karmazin added.

A combination of the two might be complicated by the fact that neither company has yet turned a profit, nor at this point seems will ever do so.
Sad but true, about a "long-investor" sitting frustrated behind his/her machine! But it's not only with this issue, but so many other issues as well: like the high gas prices! If they think this merger is anti-consumer then I do not trust their judgment on anything else. And I will never support any NAB cause nor any of their scared backers. I like SATRAD for the music, sports and culture. I have never heard Howard or any of the talk shows. With me SATRAD even competes with television. Nothing interesting on TV, turn on Sirius.

I don't care anymore if this merger goes through or not, but is anyone who is against the merger or for the NAB at least acknowledge that there should be a ruling? I mean it has been over a year and yet no ruling.

While Mel created the blunder, it takes two to tango, and XM's management was stupid enough to get sucked in to what is clearly, one of the most ill-conceived business deals in history.
And XM management could end this thing in an instant by walking away from it, and they have stupidly refused to do so.
Mel's company was already a train wreck, so his efforts to do something different at least made sense. XM could have continued as a separate entity and done fine -- assuming, of course, that had started making good business decisions.
Now, both are train wrecks and every day that passes makes it less likely either will be able to pull itself out of the muck once this horrid deal is finally called off.
I think the merger just got canelled and now maybe XM will improve programming and put out a better Inno.

Let me give you a car guy’s perspective
I have been selling Chevys for over 15 years and I think the addition of XM satellite radio (and a choice) was one of the best things that they have offered in a long time… until recently. In today’s market the #1 concern to the consumer is gas mileage then safety then… then… then… the audio system is at the bottom and not that important. Actually, I take that back, In the past “does it have satellite radio?” has been replaced with “does it have an iPod input jack”. I can’t speak for the other car lines but I think the iPod is slowly killing the satellite business. If they (FCC aka Kevin) doesn’t get off thier butts and make a decision, I’m afraid there won’t be any satellite radio left. Lets face it, both companies are on life support or “capital” support from GMAC in XM’s case, Sirius stock is at an all time low today of $2.41; I heard this merger is costing each company over one million dollars a week (?) to keep going, could this be the game plan of the FCC all along? Wait until they are both about broke and so desperate to make a deal that they will go for any thing the FCC throws at it? There is an old saying in Texas that I think works great here as a message to the FCC: “SHIT OR GET OFF THE POT”… before it’s too late.

As others have mentioned, I place much of the blame on MEL, and think he should step down, or be fired. MEL should have been fighting for we consumers, and stk hldrs, long ago.
