On April Fools Day, Chester Davenport and Reverend Jesse Jackson met with the two Democrat FCC Commissioners, among others, to discuss their proposal for divesting the broadcast infrastructure of Sirius Satellite Radio Inc. and XM Satellite Radio Holdings Inc., according to a recent ex parte filing.Specifically those in attendance at the meeting were Chester C. Davenport, Founder and Managing Director of Georgetown Partners; Rev. Jesse L. Jackson, Sr., Founder and President, Rainbow PUSH Coalition; and Kimberly Marcus, Rainbow PUSH Coalition. From the FCC Commissioner Adelstein, Commissioner Copps, Rudy Brioché, Rick Chessen and Scott Deutchman were in the meeting.
In addition to discussing the forced leasing of spectrum to Georgetown Partners, Jackson and Davenport also discussed the DOJ's decision not to block the Sirius-XM merger. Georgetown stating that "the decision is contrary to years of well-established law in the antitrust area, as well as sound public and economic policies."
They added that the Justice Department's decision "rewards Sirius and XM for their failure to honor the commitment they made to the Commission to develop and market an interoperable radio capable of receiving both Sirius and XM."
In an earlier filing (PDF) made public last week, Georgetown detailed that the public interest, in their opinion, would be achieved by requiring that "[a] minimum of 20 percent of the total satellite DARS capacity and access to the requisite infrastructure" be made available to an independent party, such as Georgetown.
Georgetown continued to propose that the lease be "privately negotiated or imposed at commercially acceptable terms" that would compensate Sirius-XM while prohibiting any control or influence over the competitor or the competitor's programs.
At the recent meeting with Copps and Adelstein, Georgetown said they are prepared to be "a viable competitor" to a merged Sirius and XM, as well as satisfy "the need for diversity."
Both Adelstein and Copps have long felt that diversity in media, or lack thereof, is a sore point in the FCC's current policy. There's no question that Georgetown Partners, with the backing of the Rainbow PUSH Coalition, brings "diversity" to the table (though, it must be noted that top executives at XM - including current CEO, Nate Davis and Chief Marketing Officer, Vernon Irvin - represent diversity that we don't see in the rest of the industry).
One has to question though... how is Georgetown Partners otherwise "prepared" to be this viable competitor? Aside from being a minority-owned, private-equity firm that analyzes FCC regulated communications markets "for opportunities to extend minority ownership and control," (their own words) - what other qualifications do they bring to the table?

I'm so happy to see all these groups and individuals not letting this things go down without putting up a good fight. The reality is that the merger, if it happens (and it probably will), will have some political causalties. This will be but the crowing example of how the Bush Admin left us with 4,000+ dead soldiers in Iraq, who knows how many from Afghanistan, tax cuts for the wealthy and for Big Oil and an extended middle finger for the rest of us.

I use to respect Jessie Jackson on my younger days; I thought he did a good job opposing the "dominant white-power-structure"; But now, after these many years, after I have matured, and been involved in the civil-rights movement myself....I see that his actions are largly "staged" and opportunistic; I don't say this as a caucasion only....many of my black brothers acknoledge this as well!

The DOJ knows and the FCC knows that Sirius and XM made the radios.
Why they were not implemented is that it would have caused the demise of XM and the loss for XM shareholders.
What i am sure happened was Sirius and XM saying to the FCC ok we did it but if you force the radios use it will be the end of XM and you the FCC with your mandate will be the cause of it.
No merger and Sirius has the right to force the use of the radios because they spent millions that the FCC forced them to spend on the radios.
The stockholders have a right to see that money put to use and you can be sure if it is not used we will see lawsuits about it not being used.
I read various posts all over the internet about how bad satrad is, in particular Sirius, but look how badly everybody wants a piece of it going forward. The NAB and others must really fear it because it will be competition unlike anything they have ever had before. With enough satrad receivers in the populace overall listening to AM-FM stations would really take big hit and they know it. The FCC is putting on the same window dressing that the DOJ did, but in the end the merger will get approved with a few minor concessions in order to justify their taking so long to come to a decision. As for Jesse Jackson, Georgetown Partners et al they are trying to play the race card which they so denouce in any other circumstance. It won't work during this administration.

Actually, the longer this merger nonsense goes on, and the more it is opposed by those who fear the competitive synergies that will come from the Sirius & XM pairing, the faster it is gaining interest. Right now, Sirius has sub growth at over 48%yr., XM slightly less. Those are tremendous figures. True, growth was much higher before all the merger confusion about which service to buy, but all the merger exposure is helping Satellite radio become much more firmly established, and understood by the public.
