Federal Communications Commission chairman Kevin Martin confirmed recently that the agency was coordinating efforts with the Department of Justice, but had yet to reach a final decision on the merger between Sirius Satellite Radio Inc. and XM Satellite Radio Holdings Inc.
Speaking informally at the NBA Tech Summit, Martin also said that while the Commission has received all the necessary information from the two satellite radio companies, they have yet to set a timeline in reaching a final decision.

"Traditionally the commission doesn't act on those after the Department of Justice --99 out of 100 times the Department of Justice goes first and the Department of Justice hasn't acted yet on that merger. We have some more information we requested at the beginning of the year from the companies so that we're trying to finalize our conclusions but we're coordinating with Department of Justice. I don't have a timeline."
Today marks the exact one-year anniversary since Sirius-XM merger was announced.


It is obvious that they don't have a timeline. Sort of like the Iraq war this thing drags on forever. Exxon-Mobile and Clear Channel have their mergers. We are left out in the cold.

I really think this is nothing new. Martin is not going to say they are close to a decision (although he did say that they were coordinating with DOJ on finalizing the decision--which is a positive statement). I would not expect Martin to anything other than what he did say. The FCC meets next week and this statement in no way detracts from or gives an indication that they would not be ready to rule at any time. All he basically said was I am not telling you when we are going to rule.
I really think what Kevin is getting at here, is that they are waiting for the DOJ, and making sure that everyone knows that. In other words, seriously, stop pressuring the FCC about the decision making process, and ask the DOJ why it is taking them so damn long..just MHO

It's a merger of equals... if it weren't, then Sirius wouldn't be giving up slightly more than 50% of the equity in THEIR company to do it. And they certainly wouldn't be giving up the majority of the seats on the new Board of Directors of the new company - to the company they're "buying out". If it were less than 50% and if Sirius maintained the seats on the Board, then yes... I'd consider it a buyout. But since Sirius is giving up so much... it is anything BUT a buyout.
Doj needs to get this right, I'm pretty sure lawyers are going back and forth, even a court settlement takes years. I'm sure they are working on this in a quick matter, 1 year isn't that bad, avg liability court cases take up to 5 years. They have to look at everything, and then take that everything and put it under several microscopes and perform more paperwork to be discussed again and again until they get a final conclusion. Real pain in the ass for investors but I'm sure they are receiving all kinds of pressure from everyone. Everyone looking for a quick buck investing in siri, good luck. I think if they merge, we're going to see an instant $4.00 and then up a $.50 every week for a couple months to hit the $9-$10 highs. Satellite is a dying breed and so we need this merger to take a decent market share from the rest of the music media outlets.
I'm sure Karmazin is going to sell the company if/after they merge. He's a dealmaker and flipper that knows how to make money, just look at his track record and plus on top of that he's Jewish. So the upside is unlimited. DOJ/FCC should allow the merger with some regulations, small spectrum taken away, price controls, a la carte. Shouldn't be a price control because if they raise prices, everyone would unsubscribe satellite radio anyways, so it's more leverage for the consumer. Consumers can easily listen to free radio, I can't really find any differences in satellite or free radio anyways. Both are full of commercials, (except for music stations on satellite) but both DEFINATELY repeat songs. If satellite didn't repeat songs, then no one would listen, not many people listen to satellite for hours straight, they simply listen on their way to work or home which is probably an hour max. So they need to keep the repition to satisfy all listeners. Same with terrestrial, but only difference is more commercials which isn't too bad. So basically I am saying satellite competes directly with terrestrial radio. On the side, mp3 players are simply storage units just like cd's, they don't deliver live material YET. Once they get internet phone music to become more mainstream then you can say phone is another mode of competion that competes with both satellite/terrestrial. In asia they are watching live Television on their phone's already. Phone's are our new media devices. One phone will have gps/internet/live tv/radio/camera everything you need for your daily lives. What else can I think of... next thing is your atm/credit cards will all be stored your phone...of course with security.

In this situation they are supposed to determine what is best for the consumer. The consumer has spoken and wants the merger. I don't particularly enjoy a lot of stuff on Sirius but you don't see me going aww man I can't wait for the murger so so and so will be out! That is not how it works.
