You know, since posting this whole rumored Stern/SEC subpoena thingy, I've been flooded with a ton of "love letters" from many extremely crazed and unstable happy and chipper investor-types. I've been so taken by the crazyness joy that I really haven't had the chance to post anything today. Madness!

Now here I am, stuck wondering how to reply to all these email - having tried so hard to reply to them on a one-on-one basis. And suddenly it occurs to me. Goddamnit, I'm a blogger, and blogging is all about transparency. It's what I do. So what a better way to get all this off my chest then to post some of the best emails I've gotten over the past 18 hours.

So, if you've got some time to burn, follow the jump and be prepared for some very long, and somewhat insane reading. After which, we will resume our regularly scheduled entries about the satellite radio industry and I'm going to stop wasting my time responding to lunatics lovely people. Sound like fun?

Listen asshole. Your obviously a XMSR long so why dont you stop the bullshit instead of driving everyones stock down ok cockscuker!

Now, that's just a few of the short ones, there were many more but I privately responded to them and they weren't nearly as interesting. Now for the kicker. The following email exchange was between myself and a very happy person. It's really really long, but... insightful... nonetheless. I'm going to post my replies as well, because, well, it's what I do.
 
I don’t know who the hell you are or think you are, but your publication of an admittedly NON-NEWS “RUMOR” was fuel for shorts, bashers, and those who wish to destroy Sirius Radio, damage its name, reputation, share price and very existence, have posted this as “news” to the internet.  Complaints about those posts, posters and you and your publication have been filed with the SEC, Sirius Radio Corporation, Howard 100 News, and the Yahoo! Abuse Dept.

I suggest you pull this irresponsible lie immediatey and cease and desist, to ameliorate your own complicity in this stock fraud scam.  The SEC itself never reveals such information and will never comment on any ongoing investigation, as to whether one even exists.  The ‘news’ has go to be bogus.  Hoaxters have been “trying to put Stern in jail” for this or that, or under the eye of the SEC, ever since he announced his move, about 1.5yrs ago.

I've been holding onto this information for nearly a week now. As I said in the article, I've contacted SIRIUS several times in an attempt to confirm or debunk this. Do you think I REALLY want to "damage" Sirius? I love them! I love the entire industry! This is what I do though and sometimes the good news comes with the bad news. That's all. 
 
Major corporations often, and in this case, probably feel that they cannot condescend to each and every rumor or allegation that gets floated by anyone and everyone.  In this case, Sirius would not necessarily have any knowledge, one way or the other.  Why contact them instead of the person supposedly in question?  I doubt he would comment either.  Likewise, I’ve already explained no one at SEC will comment.  You therefore have an unsubstantiated rumor that no one can or will confirm or deny.  You may as well print absolutely anything about anyone.  I’ve seen rumor like this hit the wires on a day when the stock was rising and then watched the stock lose *MILLIONS* of dollars in shareholder value.  I trust you’ve pulled it by now.  Otherwise, you continue with a legal exposure from SEC, Sirius Radio Corp, Mssrs Sternj and Karmazin, the shareholders themselves, and possible others.  –gv

PS:  Please respect my privacy.  I trust you are a Sirius fan and advocate – I wish you no harm, but hope you’ll pull that posted rumor.  I won’t take any further action.


I have had an open line of communication with SIRIUS for quite some time now. When they've asked me to pull content in the past, I have always done so - immediately - and out of respect and appreciation for their service. When it comes down to it, I'm an advocate for the satellite radio industry as a whole. But again, sometimes the good news comes with the bad.

Thank you.  At the same time, you probably (if you’re not a shareholder) have no idea of how a criminal element can use something like what you posted to create the illusision or impropriety and do actual and severe damage to the share price and technical chart movment of the Price Per Share itself.  Therer have been numerous such hoaxes already that have been damaging to Sirius, its shareholders (Mssrs. Stern and Karmazin included) – in the amount of millions if not billions of dollars.  We also have had SEC investigations into various matters, such as Chaunce Hayden and his activities and comments, the non-guilty admission of a Stern accountant who paid an SEC fine for ‘insider trading’, and recently various scum-poster trolls to the Yahoo! forum on SIRI who have acknowledged having records demands, etc.

SO:  Last I checked, you totally bogus and unsupported ‘rumor’ is still there – my WAG being that you seem to be enjoying the attn. if not the controversy, despite potential consequences and losses to many innocent people who do not deserve to lose $1000s, 10s, 100s or more of $1000 – over your “fun”.  Likewise, there is an element involved who have bandied about threats of violence and worse, as you might imagine in these matters, and have thought it likewise “fun” to call for denial of service attacks on phones, servers, fax machines, etc. – all violations of not only SEC, but FTC, FCC and/or other Regulations of USC Titles (Federal) – remeinsicent of the guy who just recently got out prison, doing 8-10yrs or so for cutting the Stern live remote feed line, back in Ohio many years ago – rival morning show – thought it was “all in fun”.  Prison.  Sir, don’t confuse me as making a threat to you – but these are huge stakes, huge amounts of money, and there are all sorts of idiots and desperate thugs “out there”.  I again suggest you have nothing to gain by thinking you gain in any attn with this BS rumor – trying to be a lightning rod for something that a jolt that is more sure to harm you than benefit.  Stop playing into the hands of the embittered XM shareholders and/or criminal element here.  Your post has ZERO news value and I think you know that.  I’ve also explained about the SEC’s policy(ies), so you know it can’t be true.  Pull the post and go on with your legit biz and life.

 
I already have stated in a very upfront and transparent manner that this is a rumor. So what would happen if I don't take down the post? I don't own any SIRI or XMSR stock and I support both companies equally. I don't see any harm in simply passing along the information given to me through anonymous sources. Don't you agree?
 
I do not agree and you do not understand, or are simply playing dumb.

Anyone can print such an allegation and say Stern, likewise, is a child molester, armed robber of liquor stores, etc. – or that you are.  It’s libel and slander, just for starters.  If you fail to understand that, acknowledge that, then you are otherwise merely in this for your own gain at the expense of truth, justice, legalitiy, and the great loss and detriment to many people, including Sirious Radio, its prinicipals, its talent, its shareholders, and many other innocent victims of the bullshit and lies you are propagating.  I doubt you’ll see any benefit from persisting in this and plenty of the opposite, which IMO you will thoroughly deserve for your selfishiness, irresponsibility and recklessness.
 
I just want to point out that I have not alleged that Stern has done anything illegal - so your libel and slander argument is slightly flawed - and I clearly stated that this is information comes from a 3rd party and may be speculative in nature.
 
You on the otherhand are inferring that I am dumb, a child molester, an armed robber of liquor stores, selfish, irresponsible, and reckless. Of all those, I have to contest these accusations, for I do not rob liquor stores! Good day to you sir! 
 
I made no allegation about you and certainly not publically – so it strikes me again that you are playing dumb.

On the contrary, what you ‘have’ you certainly know is not “information” of any kind – just someone else’s (I now suspect your own) 100% pure bullshit contrived allegation – invented out of whole cloth – since you choose to perpetuate and promulgate it – knowing it cannot and is not founded in any truth whatsoever.  Why do you choose to play games over this?  You seem to be the owner and/or author of a website and/or blog – don’t you want to have any credibility?  You haven’t shown evidence of having the principles or understanding of the most basic essentials of journalism, as I was taught in high school, circa 1966 – as a published contributor and award winning writer for our own school newspaper.  (This is rhetorical – no need to correspond further with me. You fall beyond a level of hostility and/or lack of intellect that precludes real communication.

 
It appears that much has changed since 1966.
