Discussions continue to heat up with FCC Commissioners over the merger between Sirius Satellite Radio Inc. and XM Satellite Radio Holdings Inc., only this time top executives from both companies were present.On Thursday, July 17th, Sirius CEO Mel Karmazin met with Commissioner Jonathan Adelstein to discuss the conditions and objections to the merger. Karmazin also discussed possible modifications to the voluntary commitment letter previously filed by Sirius-XM.
On the same day, representatives from Sirius and XM met with Commissioner Deborah Taylor Tate and Amy Blankenship to discuss the merger as well as matters pending before the Enforcement Bureau.
Also on July 17th, XM chairman Gary Parsons and CEO Nate Davis, alongside others from XM and counsel for Sirius. met with Catherine Bohigian, Chief of the Office of Strategic Planning and Policy Analysis.

Adelstein said the FCC is in discussions with XM and Sirius. "There were major infractions of FCC rules," he added, but would not say whether he favored fines or a consent decree."

Each company has a large enough subscriber base to turn a profit, or at least be consistently cash flow-positive. The synergies behind a combination would be great, but who would agree to freeze rates for six years?
Record labels already have a deal in place in which their royalty share increases from XM and Sirius. As the NFL, baseball, and Howard Stern deals come up, they, too, will likely command higher markups. If XM and Sirius can't raise rates for six years, they could suffocate. What would happen to a cable provider like Comcast (Nasdaq: CMCSA), or a satellite-television company like DirecTV (NYSE: DTV), if it couldn't pass on programming increases to its subscribers? Synergies or not, you don't want to see what XM and Sirius will look like in four to five years if they can't have consumers help pay for their growing overhead.
Then you have requests for the allocation of a growing chunk of XM's and Sirius' spectrum to public-interest programming. With the 19 million collective subscribers lacking interoperability out of their present receivers, surrendering 25% of their bandwidth for non-commercial channels means less premium content. It may not matter once the next generation of interoperable receivers become the standard, but for now, that requirement is just crowding out the content that consumers are currently willing to pay up for.
So why play this game? Walk away, XM. Run away, Sirius. Pull the rug from under the lobbyists, legislators, and regulators who have been making you stand around and wait for 17 months. You're both strong enough to survive on your own. You may need to cut costs, make difficult programming decisions, and possibly increase rates, but at least you can do those things now, while you still have the freedom to do so."

Since I did not hear anything from anonymous cowards when I first posted this, I thought they may have a second chance to respond. Disclosure: Double Lifetime Sirius Subscriber, not a anonymous coward (Yes, I might be a bit biased). If Sirius/XM merger is approved, the NAB and friends will have a harder time convincing anyone to go back to terrestrial (terrible/testicle) radio. Already I had three friends/family pick up Sirius radio, and they love it as much as I do. Although Howard Stern was the icing on the cake, the music channels sold me. I got tired long ago of the same 30 songs all the time, with all the commercials. Regardless of which service you subscribe, all satellite listeners have already experienced all kinds of music/entertainment/talent unavailable or limited by the need to sell airtime and robust censorship regulation. Satellite service is paid for by the consumers, like HBO and Showtime is paid by those who choose to receive that programs. Why haven't the NAB television group seriously went after them by now? Members own them (Time Warner and CBS Corp.). That is why independent companies who innovate need to be shut down by the old guard. Can't have their piece (excluding the Clear Channel Deal with XM, naturally bastardized by commercials), so they have to grind out this merger, to the point it's damn near nonexistent. So I'm not going to DISCOVER anything new by changing my station everytime I enter a different region any time the AM/ FM/HD station drops out. When I entertain friends, I don't need to make complicated playlists on my iPod, I just tune in to what they like. Chances are good that I like their music as well. With stations with many decent formats that have been aborted just to make a buck elsewhere, TERRESTRIAL RADIO IS DEAD in my eyes. Even when I make quick trips, I have to bring my iPod/satellite radio with me to avoid the same 30 songs. Male satellite users, you ever notice how it impresses the ladies? :) OK, one thanks to Clear Channel. WDVE in Pittsburgh has the comedy bits of the morning show I do like on podcast. Now I get a laugh and not have to listen to commercials/same old playlist. HA! Since you got the idea to put commercials on the podcasts now, I can edit them out if I want. Not too much trouble. Why do I need to dedicate myself for an whole hour, when I can be satisfied with "50-minute music hours?" I don't need seventy channels of commercial-free music that's not public broadcasting. Just give me sixteen channels of live remotes, used car pitches, and HD signals that drop out before I leave the city limits. It's not just Howard Stern fans that left regular radio. It's good that satellite radio doesn't compete with terrestrial radio. If they did, can you imagine the opposition terrestrial and the NAB would have to this technology? They would probably resort to anything in order to destroy such a formidable potential competitor. Nothing to worry about; terrestrial says that satellite doesn't compete with them. I am so relieved. Holy shit, I was having a bad dream! I don't have to worry about this scenario becoming reality. What a nightmare that would be!

I really appreciate your proposal of a six year price freeze on satellite radio's rates! You really care about me and all the consumers out there. I mean, that 43 cents a day is killing me, especially in light of the bad economy and everything. Your idea just might keep me from getting evicted. Can you believe that my gas,electric,cable,phone (and cell phone),internet,garbage removal and water rates go up all the time!? You aren't going to believe this, but there is nothing I can do about this situation. I so wish that there was someone like you to protect me, a powerless consumer, from getting abused like this.
