More Democrats are weighing in, urging the FCC for stronger conditions on the merger between Sirius Satellite Radio Inc. and XM Satellite Radio Holdings Inc.In a letter to FCC Chairman Kevin Martin, five House Democrats from Minnesota voiced their disapproval for the 8% spectrum set-aside for non-commercial/minority programming that Sirius-XM have proposed.
Reps. Betty McCollum, James Oberstar (pictured), Collin Peterson, Keith Ellison, and Timothy Walz feel that Sirius-XM's proposal of spectrum set-aside could instead result "in fewer noncommercial channels for satellite radio customers than they currently enjoy." Instead, the are asking for a minimum of a 25% set-aside, echoing a similar request by other key Democrats that include Sen. John Kerry.
The Representatives also would like
to see HD Radio included in all new satellite receivers, as it would, "encourage competition in the digital terrestrial
market and would leverage the millions of federal dollars already
invested in the conversion of noncommercial stations to HD Radio
technology."
For some reason, they also warned that approval of the Sirius-XM merger without conditions would be "to the detriment of the public interest," even though the companies have already agreed to merger concessions.

Had they ruled by 12/1/07 (a reasonable time for the thinking working person ) Sirius was at 3.83 and XM at 15.60.
Now at 1.90 and 8.00 the combined market cap loss is 5.22 Billion.

I was watching one of the congressional hearings and one congressman was pronouncing Sirius as Sigh-or-es. The only one I have been impressed with is Congressman Rick Boucher. He is the only politician I have ever heard that had actual knowledge of the subject being discussed instead of just reading a speech prepared by someone else or blindly taking the stance of the lobbyist that contribute to his campaign. Congressman Boucher is on the Telecommunications and the Internet Subcommittee, and while the other members can't turn their computer on without help, he speaks as if he is an IT professional. It is surprising to listen to a 62 year guy with that much knowledge about technology. He knows the merger will benefit the consumer and for that reason he supports it.

The listener will have to buy a sub to Sirius/XM,Apple iTunes sail increase, the new 3G iPhone has additional capability and applications. The software to get to the Sirius/XM programming could be sold by Apple at the new Apps store being introduced on July 11. The Washington leaches get ZERO. How many more of these senile, depends wearing, nursing home escapees do we have to hear chime in before a decision is rendered? This is the biggest miscarriage of justice over a prolonged period of time that I can ever remember! Our government has no shame at all. This is really unbelievable, and is a clear example of why people in this country have lost faith in politcians..... and our system of government. The whole process needs to be overhauled. WASHINGTON (Dow Jones)--There's a move in Congress to force XM Satellite Radio Holdings Inc. (XMSR) and Sirius Satellite Radio Inc. (SIRI) to further expand public and minority channels as a condition of their merger. But the proposed additional concessions aren't likely to prevail, according to people familiar with the deal.
Two letters sent last Friday from members of Congress to the Federal Communications Commission asked that the merged entity set aside 20% to 25% of its airwaves for public and minority programming. FCC Chairman Kevin Martin has recommended an 8% set-aside.
"With the commitments the two companies have offered, on balance, this transaction seems to be a fair way to compromise," said FCC Spokesman Robert Kenny, responding to the letters.
In addition to the 24 channels that would be devoted to minority and nonprofit programming, XM and Sirius also have pledged to cap subscriber prices for three years if the merger is approved.
Martin's recommendation to approve the merger now is being considered by the other four FCC commissioners. The parties are hoping the two Republican commissioners will soon sign off, which, with Martin's support, would effectively seal the deal.
People close to the talks say Martin's recommended conditions have been carefully negotiated, hinting that there may not be much more wiggle room on the terms.
Republican commissioners Deborah Taylor Tate and Robert McDowell are asking questions about the proposal, FCC officials say. Democrat Michael Copps is probably the least likely to sign off on the merger, having publicly stated his concerns in recent weeks. Jonathan Adelstein, the other Democratic commissioner, hasn't announced a position.
Sens. John Kerry, D-Mass., Claire McCaskill, D-Mo., and Ben Cardin, D-Md., penned the stronger of the two most recent congressional letters, saying a 20% spectrum set-aside is on the low end of what they would recommend. "The commission should require the merged entity to lease as much as 50% of its satellite system capacity," their letter said.
House Minnesota Democrats, in a separate letter to the FCC, recommended that 25% of the satellite spectrum be reserved for noncommercial and minority channels.
Both letters also say satellite radios should be integrated with HD radio capability.
Lawmakers can't stand in the way of the merger if the FCC approves it, but they hope to influence the deliberations within the commission.
Sens. Kerry and McCaskill both sit on the Senate Commerce Committee, which has jurisdiction over the FCC. McCaskill, with Sen. Olympia Snowe, R-Maine, earlier called on the merged entity to divest up to half its airwaves.
House Energy and Commerce Chairman John Dingell, D-Mich., and Telecommunications Subcommittee Chairman Edward Markey, D-Mass., also have asked for conditions on the merger, but they have not addressed spectrum set-asides
The Minnesota Democrats, led by Rep. Betty McCollum, primarily are concerned about maintaining healthy public radio coverage, according to several staffers. Minnesota Public Radio is a leader among public radio broadcasters.
A requirement that the merged entity's satellite radios not interfere with HD radio signals would go a long way toward resolving the Minnesota Democrats' concerns, several staffers indicated.
Incorporating HD radio technology into satellite radio "would encourage competition in the digital terrestrial market and would leverage the millions of federal dollars already invested in noncommercial stations to HD radio," the McCollum letter said.
The proposed satellite merger, announced some 16 months ago, was approved with no conditions by the Justice Department earlier this year.
The National Association of Broadcasters, which is fiercely opposed to the deal, has been circulating lawmakers' letters asking for conditions. NAB declined to comment on the specifics of the conditions, however.

I'm struck by how this merger has distracted the real issues we should be debating.... What went horribly wrong with the satrad business model. We are past determining if two companies could make it.... they can not. NOW we wonder and look at the future and ask, or should be asking... can TWO combined companies "make it" or at least, in my case, make it whopping, fucking good.
I don't think they can.... I think this model maxes at 52-60 million subs and I'm not sure how much money they will throw off... but my best guess is 2.8 billion of profit on 6 billion in sales sometime in 2015 -2017. This makes each share worth between 12-16 per share BTW..... BUT this is small fucking change compared to the potential .... this is small thinking... this is NOT how Mel thinks, or has ever thought. It has never been just about "surviving" for Mel... it's been taking all the fucking marbles...the big Cat's eyes for you old timers.
I'll tell you where I'm going with this... I think backseat video gets dumped... and I think NAV gets dumped....and I think SIXM goes for a piece of the 4.0 Billion ad market by offering split services via that bandwidth.

I also have been told there is a switching signal with HD RADIO that constantly interfers with reception. Jim Cramer has stated on today's Wall Street Confidential on TheStreet.com that regulators won't block the XM (XMSR) & Sirius (SIRI) mergerbalked.
Cramer said the XMSR/SIRI deal is a LAY-UP and that Martin has probably green-lighted this deal. Cramer said iPod and Free Terrestrial Radio compete and all the show trials and show hearings will take place before they approve it. He also thinks it could take a year to get done. Keep in mind that just last night the ex-FCC head (Michael Powell) also noted that he believes this will ultimately get approved.
Many Retailers Forecast ’08 HD-Radio Gain
NEW YORK — Sales have been picking up and will likely get an additional boost this year from a growing selection of affordable products and the launch of iTunes Tagging.
The digital-AM/FM technology could get an additional boost if more retailers focus on HD Radio’s ability to deliver multicast stations and if more retailers install outdoor antennas to deliver a compelling demo, HD-Radio developer iBiquity Digital noted. In its latest promotional campaign, the HD Digital Radio Alliance has already shifted to focus mainly on multicasting’s benefits.
When the first HD Radios hit the market in 2004, digital FM stations had not yet begun to multicast an additional channel using digital-FM’s multicast capability, but now more than 800 FM stations are broadcasting two to three programs simultaneously on their assigned frequencies. "We always had a vision it was about the additional applications it would bring, but out of the gate, the only thing we could say was it sounds better," said Bernie Sapienza, iBiquity retail business development VP. "Unfortunately, that’s what stuck with retailers, but our best application is multicasting, and we recently released another application called iTunes Tagging."
In the future, Sapienza added, HD Radio will also offer "conditional access," or the ability to pay for select programming, he continued. "If Bruce Springsteen is playing tonight and you don’t have a ticket, you could pay a buck and buy that one concert on your radio," Sapienza said. Listeners could also buy individual sports games. "You may say, I don’t want to pay $13 a month [for satellite radio], but I’ll pay $1 just to listen to a Browns game."
In home audio, MyerEmco purchasing VP Dave Glassman foresees long-awaited gains. "HD Radio is being included on more and more [A/V] receivers that are in the popular price points, so I think you’ll see a pick up in interest.
Flanner’s audio buyer Jarrett Ernst described his home HD Radio as "doing very well," and Crutchfield said it is seeing some momentum build on the home side.
On the car side, "HD demand is growing," said Dan Jeancola, merchandising senior VP for Car Toys. Dual and Jensen CD players with built-in HD-Radio tuner "have been very popular," he said. "And there is excitement from our sales team and customers about the upcoming add-ons with iTunes tagging."
Neil Riffer, mobile electronics buyer for ABT Electronics, agreed that demand is rising on the car side. "We’re getting more people coming in and asking for it," he said.
Action Electronics called HD Radio an opportunity for mobile specialists to replenish lost satellite radio sales. "We feel that HD Radio is just stepping in where satellite radio dropped the ball," said owner Mark Gebeloff. "The merger is on hold, and you can’t get [satellite-radio car] product."
For its part, mobile specialist Westminster Speed & Sound is promoting HD Radio as a way to boost margins. The company has been pushing the JVC KD-ADH39 in-dash CD-receiver. "We found we can take a customer who was going to buy a $120 CD player and bump them up $80 to a $200 HD Radio," said owner Mark Miller. "There is demand. Some people are asking about HD, and others like the idea once you mention there’s no subscription."
At Sixth Avenue Electronics, operations VP Tom Galanis said HD Radio "is picking up in both home and car." Although he described current sales as "OK," he pointed out that "HD-Radio products are starting to become more accepted." Sixth Avenue carries A/V receivers with HD Radio along with some car stereo, and the company plans to add tabletop HD Radio.
Sixth Avenue and other retailers said they promote the technology’s sound quality. "That’s the big advantage compared to Sirius and XM — it’s a huge difference in sound," Galanis said. Flanner’s, on the other hand, promotes HD Radio’s ability to receive extra stations through multicasting. "That’s our main pitch," said Flanner’s audio buyer Jarrett Ernst. In Milwaukee, he noted, the sole classical radio station ceased broadcasting, and the only classical station is now exclusively on HD Radio.
The Flanner’s buyer also claimed his HD-Radio sales over Christmas "were spectacular" in Sangean and Sony tabletop radios.
It is quite unfair for any agency government or business executive to take so long for a clear cut decision. This combination of Sirius an XM are required for the U.S. to continue our economic underpinnings of innovation, and future export capability. Remember the combined firm still only covers 48 states and we as a country are part of a worldwide economy, (I think Bush may remember that), We can win or stifle our competitiveness on a worldwide basis. Let us get this approved, or we will continue the demise of the U.S. Remember the dominance of Rome, Britain, Egypt etc. Without the understanding and actions required, we as a country will become second rate. As a student of history, It’s ironic that we approach the Independence holiday waiting for word on a merger that was proposed more than 515 days ago. Honoring our founding fathers and this nation reminds us of the conviction, the courage and their wisdom it took to do the right thing despite the political pressures and personal risk of the day.

I'm with you on this plowboy. All those deactivated factory installs are $ for Sirius. I think some of the spectrum will be free and ad supported. This gets all the deactivated receivers back on line. I don't agree that video and nav will get dumped. It will be part of a premium package that people will suscribe to and pay for. I'm not sure when it will happen. Probably not until the market is saturated with dual band receivers. But, sooner or later, it will happen (free service ad supported for part of the spectrum).
This is why the NAB is fighting so hard to stop the merger. As sat rad becomes standard in all new vehicles, Sirius with free service ,will compete with AM/FM. This will be a deathnail for testicle radio. Especally with nationally syndicated talk radio.

I'm so pissed off at the situation that I sometimes neglect to mention that Sirius has been less than prudent in terms of spending, business decisions, etc. There is no denying that (XM also); they have created a huge financial mess! However, in lieu of so many other mergers being approved - many of which have impacted the publics lives far more than this one ever will - I see no scenario by which any sane person could be so vehemently opposed to these sevices combining.

Why is it legal for politicians to accept "campaign contributions" when this is clearly not in the best interest of the citizens they are suppose to be representing? When they ask for a percentage of the spectrum to be set aside, what do they mean? Is this a percentage of channels or a percentage of bandwidth? For example, if it's just a percentage of channels, could Sirius-XM just agree to it and then compress the hell out of them?

I apologize for ranting, but, to say I am getting a bit frustrated by
this political process would be a massive understatement. When I
posted in September that I believed this process was going to take
until the end of March people thought I was crazy. But I had no idea
they could drag this out for so long. We are so close. Hopefully,
just one more step to go, the FCC vote. Unless, the FCC approves the
merger and then Congress rollsback the FCC's decision like they did
with the media consolidation decision. Then the President (if it is
still Bush) will veto the rollback. Congress will then attempt to
negate his veto with a two-thirds majority vote.
It seems clear to me now why the commissioners are not casting their
votes. Why would you cast your vote and lose out on all of that
money. The first one to cast their vote won't get paid a dime.
However, the swing vote could make some serious money and you can't
be
the swing vote if you vote first.

process, if you were to vote for John McCain, you are not electing
John McCain to be President. You are electing Merrill Lynch,
Citigroup Inc, Blank Rome LLP, AT&T Inc, the dreaded Goldman Sachs

distributors in the nation, just to name a few, to be President of
