More Democrats push FCC for merger conditions

Rep. James OberstarMore Democrats are weighing in, urging the FCC for stronger conditions on the merger between Sirius Satellite Radio Inc. and XM Satellite Radio Holdings Inc.

In a letter to FCC Chairman Kevin Martin, five House Democrats from Minnesota voiced their disapproval for the 8% spectrum set-aside for non-commercial/minority programming that Sirius-XM have proposed.

Reps. Betty McCollum, James Oberstar (pictured), Collin Peterson, Keith Ellison, and Timothy Walz feel that Sirius-XM's proposal of spectrum set-aside could instead result "in fewer noncommercial channels for satellite radio customers than they currently enjoy." Instead, the are asking for a minimum of a 25% set-aside, echoing a similar request by other key Democrats that include Sen. John Kerry.

The Representatives also would like to see HD Radio included in all new satellite receivers, as it would, "encourage competition in the digital terrestrial market and would leverage the millions of federal dollars already invested in the conversion of noncommercial stations to HD Radio technology."

For some reason, they
also warned that approval of the Sirius-XM merger without conditions would be "to the detriment of the public interest," even though the companies have already agreed to merger concessions.

Had they ruled by 12/1/07 (a reasonable time for the thinking working person ) Sirius was at 3.83 and XM at 15.60.

Now at 1.90 and 8.00 the combined market cap loss is 5.22 Billion.

Sirius/XM will walk away from this sort of NAB/Democrat proposed deal as the spectrum wouldnt be available to share between the two companies if they had to give up so much--In a political season, it looks good to say your fighting for a certain group or interest--The proposal to include HD radio is also a joke--How about they pay the NAB to be able to offer HD in the radio too? lol Come on people--My faith in govt is so low right now--(and Congress overall lower ratings then Bush prove that)

These people could not even name the two satellite radio companies without it being on the teleprompter in front of them. I was watching one of the congressional hearings and one congressman was pronouncing Sirius as Sigh-or-es. The only one I have been impressed with is Congressman Rick Boucher. He is the only politician I have ever heard that had actual knowledge of the subject being discussed instead of just reading a speech prepared by someone else or blindly taking the stance of the lobbyist that contribute to his campaign. Congressman Boucher is on the Telecommunications and the Internet Subcommittee, and while the other members can't turn their computer on without help, he speaks as if he is an IT professional. It is surprising to listen to a 62 year guy with that much knowledge about technology. He knows the merger will benefit the consumer and for that reason he supports it.

He lied. Then in April,Kevin Martin said it would be soon. He lied again. Then he said decision would be by June 30.

Let the FCC, Congress, NAB and all special interests lined up at the trough with outlandish conditions continue stall the process. Since Sirius and XM have the go ahead from the DOJ concerning competition, a JOINT VENTURE or CARTEL should be formed. As separate entities both companies could go foreward with new initiatives without conditions while the FCC fiddles and the regulatory process for MERGER burns.

Take the best of both online programming excluding Howard, Playboy, live sports and establish a new SIRIUS/XM internet website for Apple iPhone and iPod Touch (world wide) only access capable of click and buy music heard on SIRIUS/XM which directs the listener to buy the song at the iTunes store. The listener will have to buy a sub to Sirius/XM,Apple iTunes sail increase, the new 3G iPhone has additional capability and applications. The software to get to the Sirius/XM programming could be sold by Apple at the new Apps store being introduced on July 11. The Washington leaches get ZERO. It places Sirius and XM in a stronger position when it comes to conditions and can be made to look like Sirius might just walk away from a merger even if it is approved. Under JOINT VENTURE this is but one of many joint initiatives.

Finding a set of conditions that everyone can live with, although everyone might not be happy with them, is essential if this deal is to happen. Welcome to the club. I said the same thing a week ago in another posting and I'm sticking by it.

How many more of these senile, depends wearing, nursing home escapees do we have to hear chime in before a decision is rendered? This is the biggest miscarriage of justice over a prolonged period of time that I can ever remember! Our government has no shame at all. This is really unbelievable, and is a clear example of why people in this country have lost faith in politcians..... and our system of government. The whole process needs to be overhauled. The majorities concerns fall on deaf ears my friends, and this is just the tip of the iceberg. The BULLSHIT is now so deep, I just wish they (XM/Sirius) would wave the white flag and walk away. At least somebody would be left with some dignity. This is a DISGRACE of the highest magnitude.

WASHINGTON (Dow Jones)--There's a move in Congress to force XM Satellite Radio Holdings Inc. (XMSR) and Sirius Satellite Radio Inc. (SIRI) to further expand public and minority channels as a condition of their merger. But the proposed additional concessions aren't likely to prevail, according to people familiar with the deal.

Two letters sent last Friday from members of Congress to the Federal Communications Commission asked that the merged entity set aside 20% to 25% of its airwaves for public and minority programming. FCC Chairman Kevin Martin has recommended an 8% set-aside.

"With the commitments the two companies have offered, on balance, this transaction seems to be a fair way to compromise," said FCC Spokesman Robert Kenny, responding to the letters.

In addition to the 24 channels that would be devoted to minority and nonprofit programming, XM and Sirius also have pledged to cap subscriber prices for three years if the merger is approved.

Martin's recommendation to approve the merger now is being considered by the other four FCC commissioners. The parties are hoping the two Republican commissioners will soon sign off, which, with Martin's support, would effectively seal the deal.

People close to the talks say Martin's recommended conditions have been carefully negotiated, hinting that there may not be much more wiggle room on the terms.

Republican commissioners Deborah Taylor Tate and Robert McDowell are asking questions about the proposal, FCC officials say. Democrat Michael Copps is probably the least likely to sign off on the merger, having publicly stated his concerns in recent weeks. Jonathan Adelstein, the other Democratic commissioner, hasn't announced a position.

Sens. John Kerry, D-Mass., Claire McCaskill, D-Mo., and Ben Cardin, D-Md., penned the stronger of the two most recent congressional letters, saying a 20% spectrum set-aside is on the low end of what they would recommend. "The commission should require the merged entity to lease as much as 50% of its satellite system capacity," their letter said.

House Minnesota Democrats, in a separate letter to the FCC, recommended that 25% of the satellite spectrum be reserved for noncommercial and minority channels.

Both letters also say satellite radios should be integrated with HD radio capability.

Lawmakers can't stand in the way of the merger if the FCC approves it, but they hope to influence the deliberations within the commission.

Sens. Kerry and McCaskill both sit on the Senate Commerce Committee, which has jurisdiction over the FCC. McCaskill, with Sen. Olympia Snowe, R-Maine, earlier called on the merged entity to divest up to half its airwaves.

House Energy and Commerce Chairman John Dingell, D-Mich., and Telecommunications Subcommittee Chairman Edward Markey, D-Mass., also have asked for conditions on the merger, but they have not addressed spectrum set-asides

The Minnesota Democrats, led by Rep. Betty McCollum, primarily are concerned about maintaining healthy public radio coverage, according to several staffers. Minnesota Public Radio is a leader among public radio broadcasters.

A requirement that the merged entity's satellite radios not interfere with HD radio signals would go a long way toward resolving the Minnesota Democrats' concerns, several staffers indicated.

Incorporating HD radio technology into satellite radio "would encourage competition in the digital terrestrial market and would leverage the millions of federal dollars already invested in noncommercial stations to HD radio," the McCollum letter said.

The proposed satellite merger, announced some 16 months ago, was approved with no conditions by the Justice Department earlier this year.

The National Association of Broadcasters, which is fiercely opposed to the deal, has been circulating lawmakers' letters asking for conditions. NAB declined to comment on the specifics of the conditions, however.

I'm on vacation this week and enjoy spending my day reading satrad, posting and enjoying the farm sans phones, faxes, and e-mails.... just me and the farting Dogs.

I'm struck by how this merger has distracted the real issues we should be debating.... What went horribly wrong with the satrad business model. We are past determining if two companies could make it.... they can not. NOW we wonder and look at the future and ask, or should be asking... can TWO combined companies "make it" or at least, in my case, make it whopping, fucking good.

I don't think they can.... I think this model maxes at 52-60 million subs and I'm not sure how much money they will throw off... but my best guess is 2.8 billion of profit on 6 billion in sales sometime in 2015 -2017. This makes each share worth between 12-16 per share BTW..... BUT this is small fucking change compared to the potential .... this is small thinking... this is NOT how Mel thinks, or has ever thought. It has never been just about "surviving" for Mel... it's been taking all the fucking marbles...the big Cat's eyes for you old timers.

I'll tell you where I'm going with this... I think backseat video gets dumped... and I think NAV gets dumped....and I think SIXM goes for a piece of the 4.0 Billion ad market by offering split services via that bandwidth.

I also have been told there is a switching signal with HD RADIO that constantly interfers with reception. HD RADIO can not be heard after driving several miles just like regular am/fm while satellite radio you can hear across the whole usa while traveling and even listen to the same station if you want!! HD RADIO has commercials and satellite radio has non on the music channels!!
