
David K. Rehr of the National Association of Broadcasters has argued to the FCC that the lease of spectrum as a requirement for the merger between Sirius Satellite Radio Inc. and XM Satellite Radio Holdings Inc. is against the public interest.
In a letter to FCC Chairman Kevin Martin yesterday, NAB president David Rehr writes that any manditory lease - even half of Sirius-XM's spectrum - would "raise more problems than it could ever correct."
Rehr argues that Sirius-XM would "improve its system features and services through the deployment of new radios" while leaving the lessee behind with old hardware. Yet, Rehr's assumption seemingly ignores the entire Open Access provision in Kevin Martin's proposal, which would facilitate the development of receivers separate from Sirius-XM.
The NAB President also suggests that proposals for a free satellite radio service, like that of Georgetown Partners, would require an entirely additional rulemaking proceeding.
Overall the letter seems hurried and unfocused, lacking any real substance. Though, that's pretty much par for the course for Mr. Rehr, isn't it?

The NAB does not represent satellite radio, therefore it does not represent satellite radio consumers. It seems to me that the NAB are misrepresenting themselves to the FCC when they claim to be arguing their case "that a merged Sirius-XM will harm consumers." Which consumers is the NAB talking about, the satellite radio consumer, or the consumers their organization is going to loose to satellite radio should the merger be approved? Maybe the NAB should discuss this technicality with their legal team, and the FCC do the same, as should Sirius and XM with their legal teams.
Please approve this merger without conditions as soon as possible.

Moments after the NAB's attempt to derail the Sirius / Xm merger fell short, another democratic representative not concerned with high oil, a mortgage crisis, high job losses or a weak dollar has decided instead to turn his attention to a radio merger affecting less than 1 % of the US population.
Reuters reports that Rep. Edward Markey, chairman of the House Subcommittee on Telecommunications and the Internet, said the Federal Communications Commission should go beyond requirements that FCC Chairman Kevin Martin has already proposed the agency impose on the companies.
Seemingly understanding that the merger will in fact be approved, Markey is asking for more concessions than have been agreed to already by the companies, as well as FCC Chairman Martin and Commissioner McDowell. The new push is for HD to be incorporated into all satellite radios. Mr. Markey would like to turn the United States into a Chinese state apparently, by compelling auto manufacturers to install radios of the governments choosing. There is a fundamental problem with this man and others like him running our Congress and our nation.
The people of Massachusetts should be outraged! Fortunately, it does appear that these communistic demands will not be considered in light of the fact that open access will provide the market with an opportunity to decide if it wants HD radio. We the people, do not need a government ordering us what to listen to.
