Sportster 5 vs Xpress RCThe National Association of Broadcasters continues to try to scuttle the merger between Sirius Satellite Radio Inc. and XM Satellite Radio Holdings Inc.

In their latest series of meetings with the FCC, the NAB is claiming that the agency "may not lawfully act" on the merger until certain documents are made public.

NAB says that these documents are related to "apparent wrongdoing" by executive and senior-level employees of Sirius and XM regarding the operations of build-in FM transmitters in radios and terrestrial repeater towers.

Representative from the NAB met with Rick Chessen and Amy Blankenship, the Legal Advisors to Commissioners Copps and Tate, respectively, on Tuesday to discuss their claims.

This latest effort by broadcasters on the 11th hour, is undoubtedly an attempt delay the proceedings even further. Let's just hope that the Commission doesn't take it seriously.

Does the NAB go after the other manufactures of FM transmitters? SIRIUS and XM were not the only companies that built these out of spec. Belkin, Griffin, Monster and others all built equipment out of spec, but does the NAB care?

A big buyout by Microsoft or Google would be just the deep pockets that Sirius-XM would need. I always felt that the merged company will not remain a stand alone company. It would be a win-win situation for investors and consumers alike. Investors would be richly rewarded while consumers would be offered all sorts of capabilities via their satrad. Perhaps this is what the NAB is mostly worried about. The whole merger thing is getting down to the wire.

Apple is going to buy either Sirius, XM, or the combined company. It's in the cards, folks. Buy that stock now - buy, buy, buy!

The end is near, the NAB must have held this card till the last minute. Certainly they could have played this card a long time ago, but they have planned it as a last ditch effort to raise doubt with the FCC commissioners. It is quite clever, try and make it look like an approval is an approval for corruption or wrongdoing. It might give pause to some, but I still expect an approval.

I would expect a vote within a week now. Independence day will be independence from the NAB in a merged company!

A buyer of the merger XM-Sirius has to look beyond today to see its full potential. It's not what it is, but rather what it will be. There are yet to be discovered capabilities with satrad. Think of it as the PC in the mid-1980's. One thing is for sure, a merged XM-Sirius will not remain a stand alone entity very long. It will surprise everybody as to how fast it will all happen. Remember, the merged company is the ONLY satrad game in town. Once it's gone, it's gone for good, but it could be purchased if the numbers are right. I won't even speculate what it would sell for, but it would not be cheap, but still affordable to a large corporation like Microsoft, Google or even Apple. These companies have deep pockets to not only buy it, but also fund any necessary R & D and/or marketing. Doesn't Apple have something like $150 billion in their war chest?

I have emailed the 5 FCC commisioers voicing the merits of the Satellite Merger and suggest you all do the same. Possibly if we bring down or overload their email server, they will not be able to ignore thr majorities will. Don't waste your time with the NAB's bedfellows (Copps & Adelelstein). Copps cites wordage from 1934 transcripts, apparently he has not kept up to the times. Instead, direct your concerns to McDowell and Tate. We have a better chance that they will be more receptive in what we have to say. Take the time .... this will be a most remembered and much discussed about public event in our lifetime, even considering our present countries state of affairs. Possibly this debacle that started officially in Feb of 2007, wiil be the impetus to thwart the corrupting influences of the lobbyists. Nice unbiased story title. I gave up on Siriusbuzz because it became so clear from the stories there that Sirius was funding the site, but now Orbitcast is going down the same road. Would it kill you to give even the slightest analysis to the claims that Sirius and XM lied to the FCC and Congress about making an interoperable radio, and that if they did, that it screwed customers. Why would the FCC make XM and Sirius create an interoperable radio in the lab and not make it available to consumers? I would've bought one, lots of people would have.

I am so embarassed to have ever been a part of the terrestrial radio industry, and by association, the NAB. What a completely pathetic organization, spending all its time trying to bring down a competitor (in its eyes) rather than improve its own product!!! WTF?!?!?

Since Satrad receviers already support analog AM/FM, this bullshit has to be over the forced inclusion of HD Radio, even though, that has been decided to the contray by the DOJ, and concessions have already been agreed upon with the FCC. Funny how the oil mergers go through in record time, but it takes years for a satellite radio merger to go through. The religious right own clear channel, and NAB, and their all pissed off because satellite has a better product and free speech, what will happen if they can't control what people say?

well looks like public radio and the nab were real busy today at the fcc. the nab repeated five times the claim the fcc can not move forward untill the "promised information" is released and reviewed..along with time to respond and file...looks like they spoke with all the legal leadership today for each branch. it looks like a total of five nab filings today..

Cramer was right today. If the FCC does not DECIDE by the end of June in 4 days...it means only ONE thing, that they are in total cahoots with the NAB, and mean to delay this until either XM or Sirius walk away. That way it will let the FCC off the hook...and ensure that one of the companies goes belly up.

Egiscoder has been posting them to the yahoo siri board for a while he only ever posted a few days worth on one of the sirius fourms on obitcast which is to bad as many people were reading them ....for some reason I cant seem to search the yahoo board by name it only brings up his information through the 22nd of june for some reason...

Who the hell nows with these Nay-Bobs at the FCC do or when ...but two thoughts come to mind from recent reading.

1. They did little on this until six weeks ago. Appears the FCC played with their peters for 14 months listening to everyone, never shutting the door to even the NAB's janitor, deciding/clarifying little. Supreme incompetence IMO.

2. The amount and content of Ex Parte filings suggest to me you're still (or could be potentially) 2-3 weeks out. Might be more spectrum given up, open access for sure, no HD proviso at this point. Much time, interest and talk spent on receivers ... why exactly, I don't know. The fur is flying now. An immediate decision seems to be something that is out of character if you assume that the FCC has character which I don't.
