The NAB yesterday sent a letter to the FCC in response to XM and Sirius' request to deny the NAB's FOIA (Freedom of Information Act) request for information related to FM modulators and terrestrial repeater compliance.
In the letter, the NAB says they would like the records made public so that they may evaluate Sirius and XM's "character qualifications."
The NAB also wants to determine "whether the companies can be relied upon in the future to comply with FCC rules or with any conditions imposed or offered as part of the merger."
How noble.

So the NAB needs this information from the FCC, so that they can tell the FCC how nasty XM and Sirius have been?
People should support the merger, if for no other reason, to defeat the NAB's efforts to damage satellite radio.

I'm afraid the merger itself may damage satellite radio. There's too many unanswered questions concerning this "merger" and with XM's actions as of late I'd prefer there be two separate companies. Yes, I know the NAB and the lobbyists are scumbags - acknowledgement of that fact and supporting the creation of ONE satellite radio company do not go hand in hand.
