NAB President and CEO David Rehr wrote a letter (PDF via SSG) to Sirius and XM, that coincided with his opening speech at yesterday's NAB Radio Show, where he called on the satellite radio industry to "voluntarily withdraw and replace all noncompliant satellite radio devices in circulation."
"...now that the FCC has approved the resumed manufacture of newly compliant satellite radio receivers, NAB urges XM and Sirius to take the next logical step of voluntarily withdrawing and replacing all noncompliant receivers already in circulation, to resolve existing interference to terrestrial radio service," Rehr wrote in his letter.
In his speech, he didn't just "urge" XM and Sirius to recall all non-compliant satellite radios, but he also went on to say that the interfering FM modulators are making satellite radio "both a subscription and a free service," and that satellite radio as a result "cannot have it both ways" when it comes to being beyond FCC indecency regulations.
Oh but David Rehr didn't stop there. He goes on to claim that the NAB isn't afraid of the competition because "satellite radio says it has at most 10 million subscribers, notwithstanding those 500,000 subscribers in empty car lots. But 260 million people listened to broadcast radio last week alone!"

If satellite radio is so insignificant, then the number of people w/ non-complient radios and using the FM transmitter (opposed to direct connect) is even less significant. Not to mention the odds of a person within range and being tuned to the same station (which would otherwise be static) at the same point in time when something indecent is uttered, is likely to be statisticly impossible regardless of the popularity of satellite radio. But given his claims that most radios are sitting unused in empty cars, well, I think he shoots a hole in his own arguement.

Wow this guy is in deed an asshole. since radios are tuned to, say, 88.7 to recieve our sat. radio signal, does that mean that 88.7 in that local area has increased ratings? just wondering. is this guy getting paid by testical radio or something? using the number of 260 million subs is rediculous. he fails to mention sat. radio didn't exist a few years ago. you see xm fans, exclusive content is important. why buy satellite for o&a when you can add to the 260 million listeners this guy uses in his arguement and listen for free?
Sure, they can ASK for the receivers to be returned... but what idiot in their right mind is going to go "Ok, I'll return my XM receiver with an FM modulator that is working great for me to get one that is weaker and will probably not work as well." All it takes is a look at how many people are still not upgrading their v1.05 Innos to the latest firmware, even though the battery drain issue has been fixed, because they want the FM modulator to work everywhere.

Of course NAB would love for XM and Sirius to replace all the radios out there because of the $$ it would cost them -- anything to hurt sat radio. Of course, just because a radio has an FM mod that may exceed the emission limit, it doesn't mean it is in use. Why return a receiver if you don't use the FM mod, and therefore don't exceed the emissions limit?

Hmmm, even a stock car stereo is capable of broadcasting soundwaves further than a noncomplient sattelite receiver broadcasts radiowaves. So a person is more likely to be able to hear your stereo than be able to receive the radio signal tranmitted by the satellite receiver.
Dying industries often do this. But they do it **TOO LATE**.
If NAB & RIAA had taken Sat Rad seriously in its infancy, they could have killed it--but isntead those dumbasses sold commercial airtime to Sat Rad.
They mirror BlockBuster in their response to the NetFlix theat--first ignore it until it obviously has to be dealt with, then do EVERYTHING in a vain attempt to crush the competition.
XM/SIRI have a better business model--Terrestrial Radio is being replaced, but they are not doing so without a fight.
