The National Association of Broadcasters has asked the FCC to stop the informal 180-day "clock," in a filing with the Commission today.
The NAB's "Petition to Defer Action" requests that the FCC formally stop the clock, so that the NAB can "review and supplement the record with certain documents related to the serious apparent wrongdoing by XM and Sirius 'executive and senior-level employees' regarding the operation of FM modulators/transmitters and/or terrestrial repeaters."
In other words, the NAB wants the clock stopped so they can review the documents released from a previous FOIA request that the Enforcement Bureau felt were fit for public inspection.
The documents haven't been released yet, because they're still under review by various parties (largely consisting of Sirius and XM). The NAB feels these documents are important to the merger proceedings because of the DirecTV-EchoStar merger proceedings. During the DirecTV-EchoStar case, the FCC felt that EchoStar's compliance record "suggests a resistance to taking steps to serve the public interest that do not serve the company's view of its own private economic interest."
So the NAB wants the time-clock stopped, so as to allow for enough time for them to review the documents whenever they're actually released.
They insist that waiting for these released documents will "shed further light on the nature and scope of [Sirius and XM's] malfeasance and the role of senior management."
"Simply put, the Commission cannot in this proceeding rely on information produced in the enforcement proceedings without the parties to this proceeding having an opportunity to review and comment on that evidence," writes the NAB in the filing.

honestly, I am to the point of saying f*ck the NAB. This is getting ridiculous to say the least. What member organizations participate in this lobbying group?? Clearchannel = $17-18 Billion monolith.. and the like...? What are they scared of? Clearchannel = PUBLIC GOOD = Bullsh*t..

sounds like a classic stalling tactic to me---petty too(things could get really nasty and downright ridiculous as the decision nears--desperation setting in now)
and a week before a decision comes out, if in favor of the merger, the NAB will probably say that they can accept a merger with a few conditions which will be so restrictive to the success of the merger that it will sound ridiculous
The NAB got their backs are against the wall. These guys are sooooo afraid of satellite radio. Its like like the RIAA and the digital download..... It just kills their business models !!
I really do not need terrestrial radio for anything anymore. My new Ford F-150 and the wifes new Ford Fusion both are permanently locked into the satellite position!!

After reading how worried the NAB is and how childishly the NAB are fighting the merger between XM and SIRIUS I went out and bought a SIRIUS SATELLITE RADIO today!!!!
The NAB has probably conceded that the merger will go through but want to delay it as long as they can. This would give the big boys the opportunity to promote HD radio without having to worry about a merged satrad entity. Its my understanding that HD radio will be heavily promoted this fall.
Another thought I have had is if the NAB can successfully block the merger whats to stop HD radio becoming a commercial free paid service!
I believe the NAB's biggest beef with the merger is that it sets a ball rolling that may eventually allow them to carry local content. This would compete with local stations at the highest level.
Mel may walk up to regulators after the merger is done and say "hey, you let us merge, how about unlocking the door for us to carry local content." The NAB would literally flip out on this proposal.
