The "Page Six" article said that Lynsi was engaged in "an X-rated romp," citing long time gossip slinger Chaunce Hayden. Chaunce claimed that a disgruntled former employee had "recently acquired rights to the video from Margera and it's soon to be released on a pay-for-play Web site." Hughes, knowing the claim was false, offered up a $100,000 reward for a copy of the sex tape.
Lynsi Smigo, 25, has named Hayden and "Page Six" editor Richard Johnson as defendants in the lawsuit filed on Wednesday. On May 5th, "Page Six" laid the blame on Hayden when reporting that its sex tape story was "entirely incorrect." In response, Hayden claimed that he made it clear to a "Page Six" reporter that he had never actually seen the purported tape.

I knew the story was faked from the beginning and the picture confirms it, Opie loves the cock! Just look at the picture that’s how most closet homo's walk with their beards. I think you may be a little offbase here. What gravy train? Are people that intent on attacking Opie accusing him of trying to drum up publicity like that? I'm no legal expert, and not really sure of the exact details...but Ben Sparks didn't publish the rumor in a newspaper. Chauncey and the Post did. You can't sue someone with telling friends a rumor. You can say anything you want to someone else. He's not even mentioned in the article...just 'a disgruntled former employee'. You can tell people anything you want to their faces....but once it goes into the media...that's a whole different ballgame. Ben wasn't named in the article...and he didn't print it...so I'm guessin he can't be sued.
