Sirius, XM MergerThe Recording Industry Association of America (RIAA) met with FCC Commissioner Deborah Taylor Tate last week to discuss the merger between Sirius Satellite Radio Inc. and XM Satellite Radio Holdings Inc.

Mitch Bainwol, the Chairman and CEO of the RIAA, and Steven Marks, RIAA Executive VP and General Counsel, held a telephone conversation with Commissioner Tate on July 17th, according to a recent filing.

The RIAA discussed their "concerns with the merger and its impacts on the recording industry" as well as some recent conversations with Sirius about them. The RIAA was sure to highlight that Sirius failed to respond to the RIAA about those "concerns."

The RRIA should not even have Tates ear ,this late in the game,nothing good will ever come out of these endless meeting.

Earlier today , Commisioner Tate said she would vote in favor of the merger , if Sirius extends the Abba Channel through 2009 .

GOOD! Sirius and xm have also both failed to respond to the FCC about ignoring and going against the agreements of their FCC license's. Time for "merge" MONOPOLY scheme REJECTION and the FCC Enforcement Bureau to start doling out penalties, such as pulling those FCC license's, fines, and jail time by the offenders taking advantage of the radio spectrum of the citizens of the US.

RIAA gets paid by Sirius and XM - I don't see why they have a concern. SXM pays for its programing. Am I missing something here??

I am confused ... how can this "MERGER" have an effect on the RIAA and the huge Revenue stream they get from XM and Sirius that they DO NOT get from Terestrial Radio?

You would think that the RIAA would be in support of a viable and economicly sound Sat Rad company to provide a revenue stream. (assuming neither company could survive without the other)

You would also think that if these companys truly had the Synergies they once claimed come to pass after the merger... there would be an opourtunity for the RIAA to re-negotiate the preformance pricing structure and increase their revenue from Sat Rad.

Why do they keep having these meetings with these groups? The deadline was in July of 2007. The FCC needs to be investigated by an independent investigator.

I know AC is stating all of those fine Sirius and XM strip them of there licesenes and all of that crap as a NAB jackass on this board. Maybe the RIAA should look at terresterial radio royalties instead of this merger.

Well meeting with the RIAA is probably a good thing. They don't want XM/Sirius to LOCK IN THOSE Prices, because then they can't get more MONEY out of them.... You know, like they do over the air broadcasters? Oh wait, THEY get music FREE......

ASCAP’s negotiators say they should receive fee payments for those new stations because the only reason most aren’t producing revenues is that broadcasters have chosen to run them commercial-free in an effort to build audiences for the future. When RMLC representatives responded that the stations are mostly running commercial free because there are hardly any HD receivers in public hands, ASCAP hauled out a Parks Associates study mentioned in an RBR/TVBR Intelligence Brief predicting that there would be 30 million HD receivers in the marketplace by 2012."

It's funny how satellite radio with a mere 5% of listenership is paying royalties and terrestrial radio with 90%+ listenership PAYS ABSOLUTELY NOTHING!!!!!!!!!!!! The RIAA should be for the merger! Period! The RIAA needs to get off there lazy rears, and go after terrestrial and HD radio for artist royalties! AND ANOTHER THING! They need to go after the Ipod influenced illegal download sites. THAT'S WERE ALL THE REVENUE IS BEING LOST! NOT LITTLE OLE SATRAD! GET REAL RIAA!!!!!!!!!

Ahhh, I see the issue. If they merge RIAA will only get 1 paycheck.

That is I think the post of the day because this is one reason why testicular radio sucks they play the same crap over and over and over again and they are too chicken to play depper tracks from artists . I agree the RIAA should be in favor for the merger but they shouldnt go for too many concessions.

someone here mentioned HD radio and the royalties from that... I wonder if thats what the RIAA is all about.. In the event HD radio is required.. I bet they want a piece of the pie. That would make sense.

Very Simple to understand. Terrestrial radio and friends are not paying the RIA for playing music on terrestrial radio. Terrestrial radio Tells the Ria (thats been trying to collect payola since the technology boom "Help us block the Siriusxm merger and we will pay you for playing music from then on.. something the RIA has been fighting for desperately.

Why else would the RIA "thats getting paid by Sirius and Xm" want to express concerns? DUH

It appears to me that the reason for RIAA's concern is that it will not collect the same amount of revenue from a merged company as it would from collecting revenues from each company separately. Why? Because the RIAA collects a percentage of revenue from each company. Let's say Sirius and XM each bring in $1000 per year in revenue. Let's also assume that RIAA collects 10% of the total revenue from each company. Currently, XM and Sirius would each pay RIAA $100, or $200 total. Now, if the merger goes through, and there is the tiered pricing, as promised by Mel & Co., and making no adjustments for churn or growth, certain subscribers choose to go with the tiered pricing, that $1000 per year from each company becomes less than $2000 from both. If you apply the same percentage of revenue, RIAA's take goes down.

Why would they want that?

I'm still anti-merger, but the RIAA could perhaps persuade me to change my view.

The RIAA shouldn't be worried, since they're going to get 8% of the combined sub base, combined or not.

If the RIAA wants more money, and that's all they exist for, they should be forcing terrestrial radio into paying the same amount.

Tate better vote YES or her hubby back in Nashville will be pissed. On of his law firms clients is GENERAL MOTORS who voted against the HD mandate and would vote YES to the merger so XM lessens the chance of going belly up.

I think the RIAA has figured out what a-la-carte pricing means to them. They only collect money on the music station revenue. Not on talk, not on Sports and not on things like direct radio sales. Right now they can't break out the difference between music an other programming. Once the a-la-carte is running, they will get less money.

Right now RIAA gets a fixed piece of my subscription, but if there's a la cart, and I don't sub to the urban channels, they get no $$ from that part of my sub. If I only want Howard or baseball and don't turn on any music, they get no $$ from me.

Bad for them.

What's it like knowing you're going to lose, ask me! I should find out if the NAB is actually going to keep paying me after the merger. Otherwise I should call my former Taco Bell manager and see if they have any openings once the kids go back to school. I'd hate to go hungry.
