Sirius, XM extend merger agreement indefinitely

Sirius and XM have to extend their merger agreement, again. This time, though, they're not messing around with any deadlines (since the FCC sure isn't) and so they've decided to extend the merger agreement indefinitely.
The two companies have agreed not to exercise their rights to terminate the Merger Agreement prior to May 15, 2008. In addition, they've agreed to continue to extend the merger agreement, as necessary, for rolling 2-week periods.
The rolling renewal will continue until either side notifies the other of its intention not to extend.

This merger is going to be denied by the FCC on the grounds of the two never being allowed to merge together during the licensing period.

The fact that they are doing the agreement in 2 week rolling periods makes me think that either one of them wants an out within the next month or so if the FCC keeps dragging this beyond mid-May.

If they were going to DENY it, they would have done so MONTHS ago. Heck...they would have done it LAST FRIGGIN YEAR.
Use your brain. The merger is a done deal. The FCC WILL approve it. The DELAY NUMBNUTS is because of the CONCESSIONS and little details being debated over.

It puts FCC(Fiasco Communications Commission) on notice to make a decision. The decision should have been made bak in March when the DOJ(Donkeys On Juice) finally made their decision. Who knows what these clowns are thinking. They are the ones that can screw up a wet dream.

DUMB CONCLUSION , If one of the companies wanted out they would say "2 weeks
and that's it " - What they are doing is not giving the Markets,or the idiots at the
FCC a timeline.

Agreed, a denial would have come already. This will be aprooved. They are just working on the concessions. Why else would these ongoing meetings continue and this be dragged on for so long. Personally, as an independent program producer I hope that the public is given greater access to this media format though.

c'mon i as an xm subscriber do not want a merger. after all, there have been comments on other posts that said "Fact of the matter Howard is Sirius". If thats the only thing i would have to look forward to for Sirius content, then don't bother.

The crime here is that this extension had to be discussed. We're approaching this as being one of the LONGEST merger requests in US history. That is sad and pathetic. Two little radio companies, and W's crew can't pull their heads out long enough to figure it out.

Indefinitely is not the right term. The companies could not walk away under the terms of the original deal without paying a fine. This time they can walk away just by giving a two week notice.
Why did not make it a month? I think the FCC does not care anyhow..
I think someone at the FCC needs to be a man and make a decision on this as it happened at the DOJ.

The reason Sirius and Xm are merging is because they know that individually niether company will survive. I, as a Sirius and Xm suscriber would rather have Sirius, but since they both know that they will go out of business without a merger, I'd have to support the merger because I can'i stand commercials, and that is what I'll have to deal with if the merger is denied.

Its easy to see what is happening. If the FCC denied the merger, they would be going against the DOJ, which would be a first in their history. If the FCC approved the merger quickly, then Sirius and XM would "win", and upset friends/contributers of the FCC (aka NAB, clueless senators etc). So basically the strategy for the FCC is to delay the decision as long as humanly possible, to potentially bleed out the 2 companies, and approve it with a ton of concessions when its already too late.

did you see the recent post here on orbitcast about mel making more than xm's management combined. Maybe sirius needs this merger to go through more than xm to survive with the premium prices they are paying mel, howard etc. How much money have they spent trying to get this merger through?
we hear over and over from the howie clones that Howard is Sirius, and if that is all Sirius can bring to the table, then i would rather not mess with xm. Maybe that is why they are in the trouble they are in, they put all their eggs in one basket.
