XM and Sirius merger
BREAKING: Sirius Satellite Radio (SIRI) and XM Satellite Radio (XMSR) have jointly filed their reply comments with the FCC.

The "Joint Opposition to Petitions to Deny and Reply Comments" is in total a 112-page document that includes more details on XM's and Sirius' A La Carte pricing plan, disputes the NAB's arguments against a combined satellite radio company, and argues Sirius-XM's case as to why the merger would be in the public interest.

This post will be updated as I read through the document. You can of course read it yourself here (PDF). UPDATE: Don't forget to read Appendices A (PDF) and B-H (PDF), some good stuff in there too.

I disagree (page 71) that terrestrial radio has only one source of income - advertising. What happened to the income off PAYOLA?

Quick question, where is the Exhibits at? I'd like to see the channel lineups for both post-merger?

Interesting they didn't argue very heavily against the Petition to Deny by Mark Cooper's group (he was a witness at the House Judiciary Hearing). And did anybody else notice in the Channel-Lineup Exhibit document, Sirius Hits One is missing from the channel list? Or am I missing it somewhere?

I have to hand it to Mel and his boys. This is an extremely well crafted set of programming packages. The price increases for some of them will be substantial, but they probably won't be prohibitive. I would upgrade to the "XM Everything and Select Sirius" package if the "Select Sirius" included Stern and NASCAR.

Sorry O & A, but knowing the enemy is the best way to fight him.

Let me get this straight... I'd have to pay a premium for "Sirius Hits 1" and "20 on 20?" Why pay the premium when you can just find your local Clear Channel station and hear nearly the same thing? I'm left scratching my head here on this one.

the summary puts it all together. one interesting note, future service features. glad to see that both are working with the govt on homeland security and disaster relief. u wud think working with uncle sam wud help in the merger process.

It looks like you only pay the $ .25, $3.00, $5.00, and $6.00 surcharges for the "A La Carte I" offering at the $6.99 price. If you subscribe to the "A La Carte II" or "Everything & Select/Top" offerings, all of the "premium" channels are included for the $14.99 and $16.99 prices.

This could have been much worse, but they still haven't told us what the Select Sirius and Top XM channels are going to be if you subscribe to the "Everything & Select/Top" offerings.

That's my biggest question. It doesn't appear that someone will be able to subscribe to the NFL, NBA, and MLB without making the switch between Sirius and XM each season. I love the music on XM, but I love Sirius's sports offerings. I can't see myself subscribing to a "Best of Both" or "A La Carte" package if all I'm going to get are retreads of the same stuff I currently have on XM.

Silly question: Would I be able to subscribe to Sirius and XM in the future to get EVERYTHING? I notice that a true "dual" subscription isn't even mentioned...at least in my quick scroll through these 200+ pages. Seriously, I can't imagine that I'd ever pay $26 for both services, but I wonder if that option will even exist. Will the next-generation satellite radio receivers be capable of receiving ALL Sirius and XM channels?

Ultimately, it boils down to the fact that the merger won't save me any money (Fungus is a premium station, and I'm not giving up the MLB) and won't increase my offerings like I'd hoped. If I want XM music and Sirius's sports offerings, I'd have to get both packages (assuming that play-by-play sports won't be grouped into the "Everything & Select/Top" choices).

So then the fear becomes if the merger won't benefit me now, will it harm me in the future? Will my favorite channels end up disappearing down the road?

See that, I'm not so bad, after all. I even kept the Virus channel in the XM programming packages. There's no guaratee that O & A will be on the Virus channel, though. I have to talk that one over with Hoo Hoo.

Give Hoo Hoo my condolences, Shyster, one of your people specifically mentioned O & A when they described the Virus channel as a Super Premium channel that is available under the "A La Carte I" offering for a surcharge of $3.00.

No mention of Ron and Fez, though.

I hate to admit it, but Mel and Co. have done an incredible job on the entire merger package. Even I'm beginning to think that it's legitimate.

But-but-but-but-but Uncle Mel said prices aren't going up.....they'll go up more after the merger as well.....

Frank the Frowner is definitely onto something here. How long will the price of the Sirius and XM "Everything" packages remain at $12.95? There's no question that the price will be going up, but when is it going to go up, and how high. A year at $12.95 would be reasonable, but how high will the price go after that. Since the price of the "A La Carte II" package is $14.99, and the price of the "Everything & Select Sirius/Top XM" package is $16.99, the price of the "Everything" package would probably be somewhere between $14.99 and $16.99. I wouldn't consider that to be unreasonable.

Besides, I'd be happy with the "A La Carte I" package at $6.99 with O & A added for only $3.00. I would never listen to any of the other stations anyway.
