The Motley Fool is right, something isn't right.
- It's been over 4 weeks since the DOJ approved the merger... and that was considered the hard part.
- This weekend, it will be 14 months since the Sirius-XM merger was announced, and almost 400 days since the companies filed with the Commission.
- And in about 2 weeks, Sirius and XM may need to extend their merger agreement... again.
"I look to a day when people will not be judged by the color of their skin, but by the content of their character."Extremely wise words by a brilliant and legendary man. If only Chester Davenport and the Reverend Jesse Jackson heeded them. Judge by merit. Not by color. By their own admission, Georgetown Partners are not broadcasters they're simply a minority-owned firm that looks "for opportunities to extend minority ownership and control," as the firm says.
- Martin Luther King, Jr.
I don't get it. There shouldn't be anymore meetings. There shouldn't be anymore filings. None of that, there should just be a decision. And the FCC has had more than enough time to make one. Nearly 400 days should suffice, be it for or against the merger, don't you think?
This is ridiculous and we need to once again make our voices heard. If you have a few minutes, please send a comment to the FCC. You can use these forms to make it easy: pick the XM version or the Sirius version, whatever your flavor.
Let them know how you feel about this madness, because one way or another, this just needs to end.

i put money on the delta merger closing before this one does
The FCC is just going to say that they've had a tremendous amount of documents to pore over due to the overwhelming response of oppositional parties to this merger. That's why it's taking so long.
Okay... so my question is, why haven't they or why didn't they put a DEADLINE out for submission of documents, complaints, etc. by all interested parties? And a deadline for meeting requests? Even given the amount of paperwork, etc., the amount of time taken to stipulate this merger is starting to wreak of something questionable and merits some oversight to make sure there hasn't been corruption going on. That's fair and reasonable. The problem with it is that it needs to happen after FCC announces their decision because an oversight investigation could take months.
The hold up is common sense is trying to win and stop the stupidity that will ruin satellite radio and bring higher prices through expensive new radios needed to get all channels and other stupid thing about this deal that just suck for the consumer.
I'd send them a letter about making a decision, but because of having to take the time to read my letter it would only cause even further wasted time. In other words, I'd only be compounding the problem. LOL
Honestly, I think the FCC is hoping they'll get the easy way out by having Sirius & XM withdraw their merger application. There's something going on why they keep dragging this out with meeting after meeting after meeting with the same people. What could they be going over in these meetings that hasn't already been discussed?
I can't help but picture it's a situation like, "We don't want a decision one way or the other, we just want you to keep stalling this so that eventually both companies go broke or suffer irreparable harm." "Ok. Come in for another 'meeting' in 2 weeks, so we can stall this for another week after that; that's 3 weeks closer for them to going out of business."
Excerpt from COMMISSIONER RACHELLE B CHONG back in 1997:
I have voted to go forward immediately to auction among the four existing
applicants. As we explain in the item, it would be inequitable to reopen the
application process at this time. These applicants have been ready and willing to move
forward for some time. They have expended considerable resources in developing this
technology. The first of these applications was filed seven years ago. Our decision to allocate the spectrum for satellite DARS was more than two years ago. These applicants have been the victims of regulatory delay and that delay should not continue.
Remember, the FCC bosses are appointed by the Excecutive Branch(IDIOT BRANCH) of the US government. The incompotence led by Kevin Martin, is not only slowing thing to a snail's pace, but showing favortism to other media and communication companies.
To let Chester Davenport and the Reverend Jesse Jackson and others try to meddle with the process after the petition filing period ended at least 3 months earlier, is a sign of weakness. Those clowns should have been allowed to even speak or write the FCC after the date set. It is time for Kevin Martin to grow his gonookies and backbone, tell Georgetown Partners where to go, and make a desicision.
FCC needs to rule today! This delay is just digusting at this point, they should be ashamed.
To be honest up until last week I was giving Mr. Martin the benefit of the doubt that he was trying to make a fair decision. Now I think something’s up, this is just a stall tactic at this point.
The FCC needs to vote NO and be done with it, then my beloved XM radio won't get screwed up.
They said they would move quickly after the DOJ made a ruling, what’s the hold up?
I can only hope Martin reads Orbitcast. Jesse Jackson's agenda is money and power, nothing ELSE! This process disgusts me!
Thanks Ryan, I sent in a comment as you suggested. THE FCC NEEDS TO SHIT OR GET OFF THE POT!
Here's my letter:
Dear Sirs,
I am a Sirius and XM subscriber. I have (4) Sirius subs and then I purchased a 2007 Honda Pilot, which came with XM radio. I am now a subscriber to both... and paying $12.95 times 2 for the primary accounts. I am also a Sirius stockholder and I feel strongly that the depressed stock price is a direct result of the lack of direction from the DOJ and FCC. Now that the DOJ has approved the merger... we are waiting on the FCC. This waiting is hurting me, the paying public, in both subscription fees and the depressed stock price. I feel that many are waiting for a decision before purchasing a SAT radio or renewing their subscriptions. Mel Karmazin has already promised and outlined the proposed subscription fees for dual service use and you can keep them accountable to those... or your modified constraints. The FCC is charged to protect the public interest but in my personal opinion you are failing to do so in a timely manner.
They should not vote 'one way or the other'. they should vote the correct way-Approve the merger!
Taking care of such issues that have careless delays, isn't that why the Mafia was formed?
Hi, I'd like you to meet a friend of ours....
I'm sure the FCC wants to say "NO," since they really don't like to re-visit decisions made years before by another set of commissioners. If they did deny, at least one bankruptcy would be sure to follow, as well as a promised lawsuit by Sirius and Karmazin. They are in a no-win situation, and they know it. I'm sure they would rather the whole SDARS disaster would just dry up and blow away right now.
This whole merger delay scenario we are in is clearly the fault of the FCC.
There should have been a merger schedule established when the request was opened up last year. There should have been clear checkpoints and deadlines set and the FCC should have adhered to the schedule.
There should have been a deadline for any input from any outside source. A cutoff should have been established and NO MORE input should have been accepted after that date.
How can the FCC make ANY decision when every day they are getting pounded with NEW requests ???
It is completely their fault for having no concept of project management.
This is just another reason in the growing laundry list of reasons why the FCC should be disbanded, and Kevin Martin and the rest of the retards on that so called board should be lickin' stamps for the post office in Dei Moines Iowa. They already lick enough Washington butt!!!!
But really Ryan, I don't think this has anything to do with race (even though all so called minority groups should climb back in the sewer). The FCC is just a bunch of lazy a-holes who can't do anything right. Charlie Brown and George W. look like the Pope compared to the FCC. But I digress...
My theory is that they'll come out with it on day 400. Even number.
I demand a timeline!!!
If I were them, I would simply withdraw the merger request. And sue the DOJ and the FCC for the sloth and indolence they have acted with in this matter. That would also screw US Electronics, Georgetown, and every other parasite trying to jump on the back of the merger.
The incompetence at the FCC makes ya wonder if the US govt. should shut the
Dept down and OUTSOURCE the service they are supposed to provide american
citizens to another country !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
Yeah, go ahead and file a costly lawsuit you have no chance of winning. That'll help the situation.
"Your honor, we need money as our business plan sucks, we're going out of business and the government won't let us form a monopoly fast enough to save us."
Good luck with that.
Yawn.
My letter below -
To whom it may concern:
In just 7 days, it will have been 400 days since XM and Sirius filed their application with the FCC for the merger.
Consumers and many organizations across different interests have overwhelmingly voiced their support for this merger.
Meanwhile, a small minority of self-serving, NAB-backed lobbyists have done everything they can to thwart this decision. Sadly, it has hurt the financial condition of both companies and confused potential subscribers. Yet no one seems to care about that issue.
I am a subscriber to both services. I CHOOSE to subscribe, I don't need to be protected by the government. I can always CHOOSE to cancel at any time without penalties. There is no contract involved with subscribing to satellite radio!
We want the opportunity to enjoy having content from both services in one place and are tired of waiting.
Please follow the DOJ opinion that this merger is no monolopy and no harm to consumers and push for approval this merger immediately.
Thanks for your time.
Settle down ladies is our current choice in satrad that bad? What is this desperate need to see choice taken away, direct competition being bought and reduced to zero, less radio for the same of more money aka the price is going up.
Keep up the cheerleading fanboys, however there are more out there which like our satrad as it is, NOT turned into a "merge" MONOPOLY
FCC do the right thing and CRUSH this "merge" MONOPOLY of Sirius/xm, it's the only pro-consumer thing to do.
Because if they crush it, XM will leave 10 Million Customers Out with no possibility of a radio in a year or two
How much are you getting paid by XM/Sirius?
I hope it's a lot of money. What did you do for a life before Orbitcast? Must have been pretty boring if this is how you spend your day.
Georgetown Partners are not programmers. Guess where they would get their programming from? You guessed it! Terrestrial radio! Sneaky bastards they are!
Leave it to the two Democratic Chairmen to screw this entire merger up and ultimately screw consumers in the end. My hate for Democrats grows stronger and stronger!
Hopefully the Republican Chairpersons will prevail and overrule these other two idiots and follow the DOJ's ruling that "THERE IS NO HARM TO THE CONSUMER"!!!!!!!!!!!!
REJECTED
I keep telling you boys, this merger ain't going to happen! Thus the consumer wins!
Like you have room to talk, Anonymous Coward. You're a blog forum pfreak if there ever was one. "merge" MONOPOLY, YES!
They call themselves Push and that is exactly what they are diong.
Jesse Jackson is a demagogue opportunist who fosters the out-of-date notion that blacks are an oppressed minority group. He keeps alot of the black community in a mental state of being a "lesser" race by the very act of demanding minority privilege simply by virtue of color. It's the concept of choosing someone because they are black instead of because they are smart and happen to be black. There are different levels of blacks just like there are different levels of whites. From poor to rich and from ignorant to educated and everything in between. You don't hear Jesse J. shouting from the rooftops about how parents and teachers need to help kids in the school system and at home. But if there's a big civil rights ruckus somewhere, he'll be there so he can get his name on TV and maybe a spot of Larry King. He's no Bill Cosby. Cosby has it right. Pull your pants up, clean up your grammer and get an education. It's the right of every American no matter the color of your skin. Intelligence is a choice and is color blind. It's about personal accountability. Nobody owes you anything. You owe yourself. I am a white American and i love seeing successful, smart black Americans making a living right beside successful, smart white Americans. There is more opportunity in this country for minorities now than there's ever been. It's a shame that race is used as a weapon so often these days. We should be more evolved than that. MLK would certainly frown on the likes of Jesse Jackson. On the other hand, he would be very proud of Barack Obama.
They need to vote no so that either or both companies can reorganize their debt structure and get on with the business of running their perspective companies into the ground yet again.. seriously, flip a coin and get on with it already...
Why didn't they have these discussions BEFORE Justice ruled?
What are they doing now that they couldn't prior to the no-harm decision?
This is Bullshit -- no other way to put it.
Maybe they are waiting for their cronies to get their money off the shorts they put on Sirius, which is why the stock has been depressed. Apparently, the options expire on 4/19, (Friday).
Does this mean a decision comes Thursday, Friday or even Monday maybe? After they've had enough time to put in their call options to run the stock back up...hmm
I think Occam's Razor applies here. The simplest explanation for the delay is this: aside from all the obstacles put up by NAB and other's, The FCC is heavy with the conscience of originally
forbidding the two companies to merge. The delay is due to their justification of the merger. They are giving time for the other competitors to get a leg up. Ultimately, the merger will be approved. I also believe their are a lot of internal politics going on within the FCC panel of 5.
I'm surprised tha the Jews don't want a piece of this, too!
"I'm surprised tha the Jews don't want a piece of this, too!"
they do hoo hoo.
"Pull your pants up, clean up your grammer and get an education."
FCC do the right thing and CRUSH this "merge" MONOPOLY of Sirius/xm, it's the only pro-consumer thing to do.
STFU
Is there any way we could get an audio clip of one of these 'meetings'' to listen to the BS that get thrown around in the room ? 'Mister chairman, we want ...'. Ya gotta feel sorry for the dude ... who would want to have to sit there and listen to that BS all day long ... over and over ...I wouldn't want his job.
I'm sure submitting more forms with the FCC would be a brilliant way to speed up the process. The FCC will no doubt read and consider each one and maybe cosult with Jesse Jackson over them. I can just see it now "Orbitcast holds up XM/Sirius merger".
Exactly. There's probably an ever growing pile of unopened emails and letters ... from both sides ... and it will NEVER stop ... until they make a decision ... can you imagine what Kevin's unread email inbasket must look like ? He's probably crashed his workstation because it ran out of disk space !!! He could probably sit there and read the stuff and after he's read ten emails ...all saying the same damn thing ... approve it - or - reject it ...and he's deleted those ten ... he's now got in twenty more in that same amont of time ... I am glad he is where he is and I'm not !!!
Kevin Martin needs to be FUCKING FIRED for the ABSOLUTELY SHITTY JOB he's done on this merger. This lolly-gagging is inexcusable. Rupert Murdoch buys whatever the fuck he wants no problem but two satellite companies can't merge to survive?!?!?! What an ASSHOLE!!!!
Just don't fire Kevin Martin before he approves the merger ... or we may have to start this WHOLE PROCESS ALL OVER AGAIN ... because they'll have another excuse ... need to get ANOTHER person up to speed ...
The delay is just another example of poorly managed government leadership and the dismal performance of the FCC.
IN the military, I risk my life everyday to protect the freedom of the good old USA.=Now the FCC Is trying their best to take this freedom away from me,telling me what I can and can not listen to.=I will listen to what I want to and that Includes=SIRI/XM combined.=JESSE JACKSON AND GEORGETOWN has absoutley no authority In this matter, but you had rather listen to them than the GOOD AMERICAN PEOPLE.=I STRONGLY SUGGEST YOU PASS THIS MERGER IMMEDIATLY=90% of the american people wants this MERGER.
Chill Ryan! It's pretty certain they have made a decision in favor of the merger and are haggling with the details. If it was a 'no', there would not be any of these 'discussions'. Simple logic. The only question to my mind is will the details be too much that XM and Sirius say, 'Sorry, we can't merge under those conditions'.
Love him or hate him, Jesse's got a HUGE following of potential subscribers and if the net result s are we get more subscriptions and help with the bottomline, we all win.
You think that all of the channels XMSR and SIRI have today are great channels ? I 've listened to maybe five channels, EVER. Its about something for everyone.
.
What is the downside to this ? We give up some reserved air space that we could have charged someone else for ? Its all about revenue.. Has anyone done a cash flow analysis to see if this would be a feasible investment ? Let's at least examine that option instead of getting upset about it.
It doesn't matter whether you agree with Jesse or not or whether he gets something for free or not or whether its fair to everyone else or not, Its about SUBSCRIBERS and REVENUE.
I might even listen to his channels, not that I take him seriously, but I would find humor in it.
"give up" some reserved airspace Paul or auction off to the highest bidder with proceeds going to Sirius/XM?
Fuck these knuckle dragging niggas. Give them nothing. All they want are handouts. Go out and earn a living. Jackson and his knuckle scrapers have been extorting money from major corporations for years,,,,,Ford, Proctor & Gamble and Mobil. Threatening boycotts of products if more knuckle draggers are not hired.
Please remove Frank Rizzo's comments - they're inflammatory and deeply offensive.
Does anybody know who Kevin Martin's boss is ?
Just curious, is there is an escalation path here ?
Yeah -Kevins boss is George W. "Buttbuds with Clear Channel,NAB, and every lobbyist with Terrestrial interests"Bush. Why else would he be dragging this out.
Jim, as a fellow member of the military, I hold the same attitude. I make sacrifices for this country on a daily basis to ensure that we keep our freedom. I also do not like the over regulation and am disappointed in the FCC and their inability to take initiative. It's a sad state of affairs.
"Please remove Frank Rizzo's comments - they're inflammatory and deeply offensive."
You forgot to add that the comments are also true.
Well the good news is this will all come to an end by next January. So let's do the math, what is that then in total ... about 700 days ?
Gee...Is it just me or has this site's pages become cluttered with advertising?
I have three SatRad Units.
I love SatRad
I could give a fuck about merger or no merger.
thj
This will be the most honest post in the forum: I am very biased on this merger because i have a deep financial interest in the stocks of SIRI, luckily i purchased my stock at 2.39 a share i hope and pray that is the lowest point it will hit, Like most i agree that the merger should go through for obvious reasons. These companies will be a power house if the merger is approved, because the national advertisers will finally put money into a media company 18 million customers and the growth rate will be outrageous not to mention the elimination of a lot of overhead in cost per subscriber and marketing costs. I know this sounds crazy today but in 2-4 years i wouldn't be surprised if the stock reaches $40. Keep in mind i'm saying 2-3 years POST merger assuming they meet our exceed the analyst forecasts and growth rates.
In the short term the stock should easily hit $5-$7 a share immediately following a approval from the FCC. You'll see a pull back of 10% than its a clear path to $10 a share by the end of 08.
EAT MORE BEEF...

JIM you are insane. What freedom is the FCC taking away from you by taking it's time and being carefull before CRUSHING this "merge" MONOPOLY? How is the FCC telling you you can't listen to Sirius AND xm now? Funny anyone can get the radio's and listen to both, its Sirius and xm's fault why one radio won't do both as they were told to provide consumers. You are DREAMING if you think 90% of the american people want this "merge" MONOPOLY maybe more like less than 1% of the american people even think about sat radio much less want a "merge" MONOPOLY taking away choice, competition, and raising prices.
FCC NO! to "merge" MONOPOLY!
I got a fun game we can play ... Top ten reasons why its taken the FCC so long to approve this merger ... I got my reasons, let's hear yours ... and don't hold back !!!

Max,
WHo the F do you think U are to think what U say matters? Your nothing but a ignorant fanboy. Suggest YOU STFU and educate yourself. the rest of us don't care what you post and sure WILL NOT follow the lame commands of a ignorant fanboy trying to act like a big shot but in reality is nothing but a ignorant fanboy who has no clue about the truth of "merge" MONOPOLY.
FCC NO! to "merge" MONOPOLY!
Ryan, again lets drop the Anonymous Cowards and as I suggested before, IP addresses be visible with working e-mails to post here. Just say the word..... These posters need to be exposed for who they REALLY are.. I believe these are radio and/or NAB proponents posting here. They are stalling the FCC and a decision is hurting the industry. There are many people that read this site and may be confused by blatant propaganda by the NAB and their advocates.
Joe Workman,
"Again" as said before such actions would be unethical AND would land Ryan in some legal trouble. Just because YOU can't handle and don't agree with what others share doesn't mean you can take shots at and expose other for their opinions. Your both ignorant and schizophrenic if you think most here posting have any ties with the "NAB and their advocates" or their opinions posted here have anything to do with "staalling the FCC" What you call "blatant propaganda" others call the truth.
You don't have to like or agree with what others post. But your post shows your ignorance of wanting to expose and censor others opinions. Perhaps you should open your mind and think, read others opinions you just might learn something. maybe.....
One could think your "NAB" or wishing harm on our current satrad industry for being pro-"merge" MONOPOLY which WILL remove consumer choice, remove direct competition, and raise prices. Two satrad providers are better than one.
FCC NO! to "merge" MONOPOLY!
....In the short term the stock should easily hit $5-$7 a share immediately following a approval from the FCC. You'll see a pull back of 10% than its a clear path to $10 a share by the end of 08.
You are dreaming AJ....Stock may see $4.70 or $4.80...but you are betting the farm on anything else. I have followed this stock daily and owned it for 5 years buying my first shares around $1.40....and selling at over 8 and 9...I have some cheap shares myself and my exit will be at $4.20...Afterwards this stock will be stagnant for some time.
Dear Coward,
Any Site administrator/owner can use any requirement they deem necessary for unruly or inflaming visitors. If he wants to use A. Coward's Social security number for login purposes and you "CHOOSE" to post here you must provide said number. So speaking of "unethical AND would land legal trouble".... Your are silly to post that. If said owner wants to ban "Certain" IP addresses it is totally up to the discretion of the owner/site administrator. Now go back to the Hell hole you crawled out from, Fu*k your mother, and flush your radio down the toilet.
Sincerely,
Joe Workman
PS. the admins do know EVERYONES identity here, your IP is very available.
Joe Workman,
YOU are NOT the site admin/owner, Ryan is and he allows the use of "Anonymous Coward" If Ryan were to give you IP address for your "buddy who does data mining" and to "sign others up for junk mail" as you asked him in a prior post would make for "unethical AND would make for legal trouble". Sure Ryan or any other site admin/owner can ban certain IP's BUT it's up to him not YOU and your BS games, and you foul mouth. Do you think it's a secret your IP is very visable everywhere you go on the net? WOW welcome to the internet and thanks for sharing the news most everyone else already knows.....
If you want to control what others post (and grab IP's) feel free to start your own web site, may I suggest www.JoeWorkmanIMineIP's.com? However this is orbitcast.com, is Ryan Saghir's baby and Ryan and Orbitcast has a great reputation to uphold, and a pretty good line up of advertisers. None of which include giving foul mouthed clowns like yourself access to others IP's opening up Ryan and Orbit cast to unethical and possible legal trouble to say nothing about the hit to orbitcast.com and it's reputation.
You want to share, others have the same right without your BS and taking shots at and desperate threats of exposing others for posting their opinions.
After your suggestions here to others, suggest you go and grow up, and worry more about Joe Workman.
TO COWARD 4/17 4:33==I feel so very sorry for you.=You said the FCC should take their time to deside this merger=I agree with you.=6=MONTHS IS TAKING THEIR TIME=TAKING 14 MONTHS IS A SHAME AND DISGRACE AND SHOULD BE INVESTIGATED.=To all the high school students on this board that says this Is a MONOPOLY,=Let me explain to you.=THE DEPARTMENT OF JUSTICE says It Is NOT.=Do you know more about the law than the DOJ.=Anyway being In high school,=This Is a good way to make a little extra money paid by the NAB.

A wonderful arguement for why handguns should be legal. And a fine example of why our nation was founded in violence and achieved by overthrowing the then government.
