The FCC meetings continue: NAB joins the fray

David RehrThe meetings at the FCC continue occur as we rapidly approach the May 1st deadline for the extended merger agreement between Sirius Satellite Radio Inc. and XM Satellite Radio Holdings Inc. This time, the National Association of Broadcasters is the latest group to enter the fray.

NAB President and CEO David Rehr (pictured) and NAB Executive VP of Legal & Regulatory Affairs Marsha MacBride, met with FCC Commissioner Michael Copps and his Senior Legal Advisor/Media Advisor Rick Chessen last Friday, according to a FCC filing.

At the meeting, Rehr and MacBride argued that a merged Sirius-XM will "harm consumers" as well as "undermine fair competition in local radio markets."

The NAB stuck to the same stale argument from over a year ago that approving the merger would "violate the Commission's long-standing prohibition against a merger of the nation's only two satellite radio licensees" that the FCC needs to be mindful of Sirius and XM's "record of violations of the Commission's rules."

How much longer does this need to drag on? Seriously. I think we've exhausted all the angles and it's time to make a decision. Nothing new is being added that hasn't already been said.

Gee.... it really shows you how truly afraid the NAB is of any competition, and how they think they think they can stick their noses into other legitimate bussiness's . I always knew satellite radio was great, but I guess I underestimated how truly bad terrestrial radio was. Kevin Martin needs to show some guts as a commissioner, and approve this merger and get things moving in a positive direction.

I think that the FCC has made a decsion, at least an initial decision and is giving all "interested parties" a chance to give it a last go. This is what happened at the DOJ prior to its ruling.

this merger crap has gone on soo long that I quite my job @ a sat rad company X and moved on.. nobody gives a sh*t outside of this clique (XM.Sir.NAB.vested interests and there aren't many left). long term play is not good.

Rehr aka. Fumbles is an ex-beer promoter and is probably a raging alcoholic - the NAB conventions are just for alcoholics and screwing prostitutes. Maybe, he has a walking case of gonorrhea and always looks angry because it hurts to pee.

Yeah, NAB is going to be history when this merger goes through. Dave Rehr won't have a job any longer. He will go down in history as the biggest loser in NAB history.

The NAB does not represent satellite radio, therefore it does not represent satellite radio consumers. It seems to me that the NAB are misrepresenting themselves to the FCC when they claim to be arguing their case "that a merged Sirius-XM will harm consumers." Which consumers is the NAB talking about, the satellite radio consumer, or the consumers their organization is going to loose to satellite radio should the merger be approved? Maybe the NAB should discuss this technicality with their legal team, and the FCC do the same, as should Sirius and XM with their legal teams.

Does ICO class as a licensed satellite radio company now - so even by the NAB's narrow definition of competition, there will still be no monopoly here.

If the FCC can't see through that line of bullshit then they are dumber than a box of rocks. The NAB are being disingenuous in arguing for the protection of the consumer when it's clear that they are concerned for their bottom line and the threat that SatRad poses to their current terrestrial monopoly. All those that doubt the future success of Siri-Xm need look no further than the actions of the NAB to try to block the merger approval. The extent to which they are trying to influence the FCC speaks volumes.

They are Competition for Sat Radio and regular radio so Sirius will not be a Monopoly if merged with XM.

I am sure that most Americans will be more affected by the Delta/Northwest merger than by two Satellite Radio companies. The DOJ apparently agrees. It seems to me that with all this stalling the FCC, would be the drunk guy with pee all over himself at the club

None of this is the FCC's or NAB's doings, "they" are NOT the "assholes". Any smart consumer has the thinking power to see this "merge" MONOPOLY is a result of both satrad companies management failures and Mel thinking a "merge" MONOPOLY is a way to make a quick buck before the whole satrad industry crumbles, because "merge" or no "merge" satrad in it's current form is DOA. Using sat's to provide audio and expecting enough consumers to become subscribers to make money has been a proven failure as neither company has ever come close to making money. Also as we've seen content costs money, satrad is a gamble at best, and the results of that gamble are shown quarter after quarter as failures.

I hate to break it to you Mr. Anonymous, but Satellite radio just happens to be fastest growing medium today, since the advent of cable tv. Satellite radio will become the established radio standard in the years to come. With or without the merger. Don't let that scare you though. You will always have your static fillled, commercial laden, thought edited, rabbit eared, what passes for "entertainment" to listen to.

I'm a sucker for options... Don't ask how much I've lost since since this thing was announced... but I keep buying. I don't care. I admit, SIRIUS stock is horrid. BUT I love this company. And if it EVER pops, I'm going to be in :)

David Rehr.......rhymes with rear, as in complete ASS! This guy looks like most every one else who is part and parcel of the Bush Administration -- like he's constipated and hasn't gotten laid in several decades. Kevin Martin looks like a complete TOOL himself. We have people in positions of power in this country who are relics from the past, appointed by imbeciles who were voted into office by morons! This merger has turned into a complete fiasco, and has exposed our government in all it's scandalous glory. Corruption personified! Has anything of so little significance ever come under more scrutiny than this issue? Not that I can remember. Why is the government even involved in this situation? The only monopoly in radio is Clearchannel. They own most of the terrestrial radio stations. They, along with the NAB and Bush's Evil Empire are all in cahoots with one another in this criminal attempt to stop this merger and put these two companies out of business. People should be outraged by this calculated and contrived merger delay. I hope Mel is consulting with his legal council in order to seek retribution as a result of this government conspiracy.

Just a couple of points of clarification. (1) ICO is now planning to use its service to offer backseat video and GPS (initially they were going to do two-way telephone service). Personally, I don't think that backseat TV and GPS is a competiitive alternative to satellite radio, even assuming ICO could actually generate any subscribers for these services. (2) Clear Channel owns more radio stations of any one company, but certainly not most of the stations. After they complete their effort to sell about 425 stations in a few months, Clear Channel will own about 800 stations, of the total 11,000+ in the country. And they are not allowed to own more than 8 in any one radio market. 8 per market compared to the 300 channels that a merged XM-Sirius will control.

May 1st is rapidly approaching and STILL NO DECISION! What the hell is Jackass Martin doing in the FCC!! I say free sat radio!!!!!

davey1975 - why would the fcc are about May 1st? its never been the gov't's job to decide on a merger or other transaction in time for some arbitrary deadline set by private industry. there's deals going on all the time that the govt has to approve. Most companies don't make public statements promising shareholders that the govt will rule by some date - only XM and Sirius have been stupid enough to do this.
