Jonathan Adelstein / David Rehr photoshopGino Lattarulo has an incredibly poignant article in SeekingAlpha discussing the disgusting flip-flop that Jonathan Adelstein displayed this past week over the Sirius and XM merger.

Lattarulo blasts Adelstein for his 6-year price freeze and HD Radio mandate proposals,both of which have the stench of the NAB all over them.

But it's his final point that I like the best:
"If after 18 months you have still have to back peddle and not stand behind your own decision, how can you possibly be trusted?" writes Lattarulo. "At least Commissioner Copps had the backbone to be decisive."

A Sirius shareholder recently filed a racketeering lawsuit against XM and Sirius. Michael Hartleib goes on to threaten that he will name the FCC as co-conspirators if they don't make public their findings in the matter of the interoperable mandate. I hope the Commission sees this lawsuit for what it is. The musings of a madman. This guy has posted numerous times on various satellite radio forums making ridiculous claims of how Sirius did not actually get shareholder approval to merge (despite the fact that greater than 95% of votes cast favored the merger) and bragging about how he was offered $500,000 by the plaintiffs' attorneys in a frivolous lawsuit against Sirius that was later dismissed. At the same time he insists that he supports the merger. Also, he falsely claims to be a major shareholder even though he only owns 151,000 shares of Sirius. Thus far, the satellite radio community has regarded his posts, even ex parte submissions, as little more than attention seeking behavior. However, in light of recent developments that are completely against our best interests, I want to invite Orbitcasters to join a growing number of us in filing a countersuit against Mr. Hartleib for his attempts to frivolously and fraudulently delay this merger to the detriment of satellite radio subscribers and shareholders.

Adelstein was trying to be a Democratic hero with a sucker proposal. If somehow Sirius-XM had bitten for that dumb proposal he would have appeared to be the man who saved terrestrial radio and would have received the support of the NAB to time indefinite. Adelstein took a chance and lost. He really had nothing to lose as he knew the likelihood of the merger being approved was high given that party affiliation was 3 to 2 in favor of approval. I know that we all want to put this chapter of our investment 'carreer' behind us and look forward to simpler investments. Any time that the government is involved in your investment stratergy you can count on rough times. Look at Microsoft where previous fortunes were made. It still hasn't recovered and remains essentially a $25 stock for six years straight.

Hartleib has completely lost it. I'd love to suit the little shit, but I don't think there will be any need for it. The courts are gonna take one look at it and throw it out the window.

I fully diagree. JA was pushing Tate's hand. Tate had no intention of being the person to move until she had to. JA threw his proposal against the wall for her to have something to shoot at. Anyone who understands these broker plays knows what happened instinctivly.

I propose that Tate would have had her finger in her ass for another three months without his suggestion that he was going to be the third vote.

Adelstein obviously realized he wasn't going to get the concessions he wanted, which he was basing his vote on. I get it. And I want this merger... but, yea... it's something to stew over....

Plowboy is spot on about the reason Adelstein floated the offer. And I agree that the photo mash misses the mark, both artistically and conceptually. At first I thought it was an old pic of Adelstein but that didn't seem quite right. The idea behind it is cute but linking the NAB with JA is simply not valid.

Your logic is that those who vote against the merger, regardless of why, are in league with the NAB. If only it were that simple.

Anyone who is familiar with Adelstein's background (or that of Copps) is laughing hard and rolling their eyes.
